Book excerpt: This document (of 196 pages) comprises the proceedings of an OECD roundtable on promoting competition in local services with a special focus on competition in handling solid waste. Many natural monopolies are not under the authority of central or federal government, but are the responsibility of local or municipal governments. Do local governments have incentives to ensure competition and efficiency in the provision of services under their authority? The answer may depend on central-local government relations and factors such as the size of transfers of funds from central to local government. In most cities, one such natural monopoly is the collection of solid waste from households and small business. How should the collection of solid waste be organised? Because the level of sunk investment in providing these services is limited, they can be purchased through competition for-the-market in the form of competitive tendering. Experience in many cities shows that competitive tendering can yield greater efficeincy and lower prices than either self-provision or regulated monopoly. However, competitive tendering is far from straightforward. Close attention must be paid to promoting competition in the bidding process, to the prevention of hold-up problems and to maintaining the incentives for investment, quality and efficient adjustment of prices over the life of the contract. How might competition in the bidding process be enhanced? What is the proper role of competition law enforcement? What is the best way to ensure that quality is maintained over the life of the contract? This document consists of a background paper by the Secretariat, country submissions from 9 OECD countries and a summary of the oral discussion.

Book excerpt: The ruling of the European Commission is that the award of contracts by regional or local authorities for the provision of services of general economic interest must be done by way of competitive tendering. Such contracts must not be awarded to the authority's own public enterprises or to any other enterprise, including by means of unilateral State act, without a call for tenders, a practice that had previously been common in many Member States. Public service concessions are also subject to the competition rules of the EC Treaty. Should the European Commission enact a directive concerning compulsory competitive tendering, this would result, for several Member States, in a serious change of paradigm as regards the awarding of public service concessions. Against this background, this article will attempt to find answers to the following questions: ő How is the present relationship of the regional or local authority with its own public enterprise to be considered? ő Are there any limits to applying the rules on competition of the EC Treaty to public service concessions? ő What kind of positive and negative effects concerning economic efficiency and supply of specific public services result from the awarding of public service concessions and from compulsory competitive tendering? ő What kind of, and what amount of, transaction costs result from compulsory competitive tendering and from the awarding of concessions? ő Does competitive tendering work properly, and are public tenderers given equal opportunities? ő Are there any alternatives to compulsory competitive tendering that would achieve an efficient market performance and provide sufficient supply?

The main objective for this study was to examine how competitive tendering could be used as an effective tool to achieve value for money in public sector procurement at the Ahanta West District Assembly. The researcher administered twenty (20) questionnaires to some selected departments in the organization, specifically the procurement unit, the stores department, the accounting department and then the engineering department. The researcher used purposive sampling as a technique to gather ample information for this work. By purposive sampling, the researcher targeted those departments within the organization whose daily activities have direct bearing on procurement. Information gathered were analyzed critically and presented in the form of tables which is readily understandable. It was found out from the analyses that the Ahanta West District Assembly uses the competitive tendering methods in awarding most of their contracts thereby procuring goods, works and services at affordable and competitive prices. However the major problem identified was that, the processes involved are seen to be complex more especially for some contractors and those employees who have little knowledge in procurement when it comes to works and also the problem of political interference .The researcher finally recommended that series of workshops and seminars should be organized for both procurement officers especially new ones who have little knowledge in practical procurement when it comes to works and potential contractors so that they will have more insight into what goes into the preparations or processing of tender documents and lastly the Public Procurement Authority (PPA) should institute measures to monitor the adherence to the public procurement Act 663 in all public institutions.

Book excerpt: This paper looks at possible problems concerning the economic effects of the introduction of an compulsory competitive tendering for general economic interest services at the local level. It examines the framework in Austria and some fundamental problems of competitive tendering. An obligation binding local authorities to put general economic interest services up for competitive tender, as currently intended by the European Commission (i.e. service concessions), would have considerable medium- and long-term effects on both the process of municipal service provision and the economic position of municipal (public) enterprises. The paper concludes that, from an economic point of view, procurement through competitive tendering does not appear to be effective or tenable for all general economic interest services in (all) different areas. The introduction of compulsory competitive tendering for service concessions in all areas of public services is therefore something best forgotten.
