Book excerpt: It has been for a longtime a usual and common practice in employment relationship that, in order to ensure prudence on part of the employer, he must subject an employee into a reasonable probationary period before he permanently accepts that employee in the position recruited. The aim of this common practice is to allow the employer to make an informed assessment of whether an employee is capable of rendering the services as intended in such a post. In response to this, the Jurisprudence of Tanzania, though not in mandatory terms, requires certain jobs to subject their newly recruited employees into probationary period. But, experience shows that, despite having this overriding objective in mind, subjecting an employee into probationary period in Tanzania is taken as a loophole of denying access to the certain employment rights and standards but also the labour regime seems not adequately provides rights of employees working under probationary period. The researcher in this study explores rights of probationary employees in Tanzania and Kenya aiming at comparing rights enjoyed by probationary employees in both jurisdictions and see what are the differences. Documentary review method was employed to collect and gather relevant data to accomplish the study. Chapter two marked as the conceptual framework part, where important key concepts relating to the study were detailed explained. Under Chapter three, a comparative study method was conducted on the legal framework governing rights of probationary employees in both Tanzania and Kenya aiming at measuring the differences that exist in enjoying probationary rights between these two jurisdictions. Chapter four presents and analyses data and findings with reference to research objectives and research questions settled in Chapter one. The analysis is based on comparison with Kenyan legal framework but also with some few cases from Colombia and Canada. The study has revealed that the principal act (ELRA) does not adequately recognize rights entitled to probationary employees. The rights and protections of probationary employees have been incorporated in The Constitution of the United Republic of Tanzania but also Standing Orders for the Public Service. Also, the law does not set forth standards to be taken into consideration to decide the suitability of the employee during probationary period by the employer. Then the study completes with conclusion and recommendations under Chapter Five.
