Wainwright that the constitutional right of criminal defendants to be represented by counsel, appointed by the court if the defendant is indigent, extended to state criminal proceedings. In the forty years that have passed since that decision, the Supreme Court has rendered any number of opinions that further expand upon and explore this critical constitutional right. The harsh reality of daily proceedings in Rhode Island District Court today, however, reveals that significant numbers of misdemeanor criminal cases are resolved by plea at the arraignment stage without adherence to the constitutional mandate of Gideon and its progeny. This essay explores the parameters of the right to counsel, the critical importance of the right to counsel when a misdemeanor case is resolved by the entry of a plea, the findings required before a court may lawfully find that the right to counsel has been waived, and the inadequacies of current Rhode Island practice in this regard.
