But it is possible to refinance an existing home with a mortgage that has the same one-in-five chance of putting the family out on the street.” More than a century after the government embraced credit to fuel the American economy, consumer financial protections in the increasingly complex financial system still place the onus on individuals to sift through fine print for assurance that they are not vulnerable to predatory lending and other pitfalls of consumer financing and growing debt. In Democracy Declined, Mallory E. SoRelle argues that the failure of federal policy makers to curb risky practices can be explained by the evolution of consumer finance policies aimed at encouraging easy credit in part by foregoing more stringent regulation. Furthermore, SoRelle explains how angry borrowers’ experiences with these policies teach them to focus their attention primarily on banks and lenders instead of demanding that lawmakers address predatory behavior. As a result, advocacy groups have been mostly unsuccessful in mobilizing borrowers in support of stronger consumer financial protections. The absence of safeguards on consumer financing is particularly dangerous because the consequences extend well beyond harm to individuals—they threaten the stability of entire economies. SoRelle identifies pathways to mitigate these potentially disastrous consequences through greater public participation.

Book excerpt: Coalitions of consumer groups, NGOs, and trade unions have traditionally been considered politically weak compared to well-organized and resourceful financial sector groups which dominate or "capture" financial regulatory decisions. However, following the 2008 financial crisis, civil society groups have been seen to exert much more influence, with politicians successfully implementing financial reform in spite of industry opposition. Drawing on literature from social movement research and regulatory politics, this book shows how diffuse interests were represented in financial regulatory overhauls in both the United States (US) and the European Union (EU). Four cases of reform in the post-crisis regulatory context are analyzed: the creation of a new Consumer Financial Protection Bureau in the US; the introduction of new consumer protection regulations through EU directives; the failure of attempts to introduce a financial transaction tax in the US; and the agreement of 11 EU member states to introduce such a tax. It shows how building coalitions with important elite allies outside and inside government helped traditionally weak interest groups transcend a lack of material resources to influence and shape regulatory policy. By engaging with a less well-known side of the debate, it explains how business power was curbed and diverse interests translated into financial regulatory policy.

Organisations including Consumer Focus Wales and Citizens Advice represent consumers' interests in their dealings with businesses, industry regulators and the UK and Welsh Governments. A significant aspect of their work is to ensure that consumers receive a fair deal in their daily lives. Advocacy is particularly important to those termed the most vulnerable in Welsh society. The Government announced its plans in October 2010 to abolish Consumer Focus Wales and to transfer some or all of its functions to Citizens Advice Cymru. The final decision will be taken once Ministers have considered the findings of the public consultation. But this delay has caused on going uncertainty and the Committee calls on the Government to publish without delay its detailed plans. MPs are not wholly persuaded by the Government's reasons for abolishing Consumer Focus Wales, but recognise that given the current financial situation there is a strong case for examining whether consumer interests are represented in the most efficient and cost-effective way. However, the Government should provide guarantees that the best features of Consumer Focus Wales are protected in any successor body, including: statutory independence from interference by ministers or its parent organization; a "Welsh focus" and the present level of funding. As consumer matters fall increasingly under the responsibility of the National Assembly for Wales, the committee calls for a review, on whether to devolve responsibility for consumer affairs to the National Assembly for Wales and that The Commission on Devolution in Wales should consider this matter when it reviews the powers of the National Assembly for Wales

Book excerpt: As a result of the privatisation of many nationalised industries in the 1980s, independent sector-specific regulatory offices were established to regulate these industries to promote genuine competition and ensure companies did not exploit monopoly powers. Examples of these regulatory offices include Oftel (telecommunications), Ofgas (gas supply), Offer, (electricity), Ofwat (water services) and Postcomm (postal services). Other regulatory offices with slightly different regulatory remits include the Civil Aviation Authority, the Financial Services Authority, the Pensions Regulator, the Competition Commission and the Office of Fair Trading. The Committee's report examines the statutory remits of the UK economic regulators, their working methods and working relationships, the value for money they provide and the extent to which the regulators have successfully promoted competition and de-regulated where possible, as well as considering whether they should be given an additional statutory duty to facilitate the competitiveness of UK firms. Overall, the Committee concludes that the legislation is working well, but that a greater standardisation of remits should be introduced over time to ensure all regulators are statutorily required to follow best practice. In most sectors, regulators have played an important role in helping to promote competition, with the exception of the water industry. The report explores possible reasons for the lack of competition in this sector, and urges Ofwat to take account of the general comments made by the Competition Appeal Tribunal on its access regime. It highlights the need for greater parliamentary oversight over regulatory bodies and recommends that a Joint Committee of both Houses be set up, or failing this, that a sessional Select Committee be established in the House of Lords.

The generally accepted notion is that it is a government instrument designed to intervene in relatively unregulated markets in order to preserve rivalry among independent buyers and sellers. Competition authorities are supposed to restrain business conduct that exercises monopoly power aimed at excluding competitors or exploiting consumers and clients. Thus it can be said - although few pro-market theorists make the insight explicit - that antitrust provisions reveal mistrust of the capacity of markets to promote social welfare. The inner logic, enforcement mechanisms, and practical outcomes of antitrust provisions are all intrinsically contradictory to the natural dynamic course of market functioning. In Dr. De Leon's challenging thesis, this mistrust of the market lies at the root of antitrust policy, giving rise always to a preference towards 'predicting' the result of impersonal market forces rather than interpreting the entrepreneurial behaviour which creates those forces. And it is in Latin America that he finds the powerful evidence he needs to support his case. From the formative years of Latin American economic institutions, during the Spanish Empire, economic regulations - far from being driven by the pursuit of promoting free trade and economic freedom - have been conceived, enacted and implemented in the context of deeply anti-market public policies, trade mercantilism and government dirigisme. The so-called "neoliberal" revolution of the 1990s triggered by the Washington Consensus did not really change the interventionist innuendo of these policies, but merely restated the social welfare goal to be achieved: the pursuit of economic efficiency. Dr. De Leon presents his case against the assumption that consumer welfare orientated policies such as antitrust do really promote entrepreneurship and market goals. Paradoxically, antitrust enforcement has undermined the transparency of market institutions, in the name of promoting market competition. The author's provocative analysis marshals several sets of facts in support of his thesis, including the actual functioning of antitrust policy as reflected in case law in various Latin American countries, the preference of merger control over other less intrusive forms of market surveillance, the constrained role of competition advocacy against government acts, and the ineffective institutional structure created to apply the policy. Among the many specific topics treated are the following: government immunity; strategic industries; state-owned enterprises; politically influential groups; measurement of market concentration; the burden of proof of social welfare benefits; the role of joint trade associations and professional guilds; institutional arrangements that favour collusion; selective distribution; sector regulation; erosion of property rights; marginal role of courts in the antitrust system; leniency programs; and privatized public utilities.
