Particularly after the Treaty of Lisbon’s entry into force, research on multilevel governance can no longer remain confined to the analysis of political dynamics or of soft law arrangements. Multilevel governance emerges as a constitutional principle in the European constitutional space, envisaging a method of governance based on the strong involvement of sub-national authorities in the creation and implementation of EU law and policy. Its foundation is in the mosaic resulting from the constitutional systems of the Union and its Member States. Multilevel governance arrangements play a fundamental part in achieving key Treaty objectives (such as subsidiarity, respect for the national identities of the Member States including regional and local self-government, openness, and closeness to the citizen). These arrangements lend legitimacy to EU decision-making, while also promoting constitutionalism and democracy in the EU.

Book excerpt: The limited scope of participation in the making of EU law remains a continued source of controversy, featuring prominently in recent institutional and political developments that have been shaping the EU's constitutional framework - most intensely in the follow up of the Commission's White Paper on Governance. Yet little attention has been paid to participation rights as a means of ensuring the procedural protection of persons affected by EU regulation in its diverse forms. This is a dimension of the rule of law that has been largely ignored by EU legislative and judicial bodies. Not only the legislator, but also the Court of Justice and the Court of First Instance tend to adhere to excessively formal conceptions of participation rights that are premised on the right to be heard in individual procedures, as well as to a restrictive view regarding the relationships between the citizens and the administration. This book shows why, in the face of new regulatory developments, these conceptions are currently inadequate to ensure the legal protection of rights and interests affected by EU regulation. Combining a conceptual analysis with thorough empirical scrutiny, this book assesses the scope of participation rights in EU law against their rationales and underlying legal values. It makes a case for the extension of participation rights to new situations and new types of procedures, in particular those that would generally fall within the category of rulemaking. Proponents of a Europe of the Regions assume that the combined effect of European integration at the top and regional decentralisation at the bottom will eventually lead to a dissolving of the traditional nation state in Europe. Others reject this view and see this development rather as the emergence of a new form of multilevel governance within the existing framework of national and European institutions. The regional element of the EU can be retraced to the establishment of the European Regional Development Fund (ERDF) in 1975 but, as Harvie points out, since that time regional development has taken a dynamic of its own which challenges the traditional nation state: 'Regionalisation, the chopping-up of problems into manageable areas, has given way to a subjective and aggressive regionalism.' Regions have doubtlessly established themselves as key players in European governance. The purpose of this essay is to clarify whether a Europe of the regions is a viable option in practice and whether it is desirable at all. To answer this question, this essay will first of all clarify the ambiguous term 'region' and analyse different concepts of regional governance in several EU countries.
