Book excerpt: "Land Law Reform examines the wide-spread efforts to reform land law in developing countries and countries in transition, drawing in particular upon the experience of the World Bank and the Rural Development Institute. The book considers the role of land law reform in the development process and analyzes how the World Bank has sought to support these legal changes in client countries. It reviews the experience with reform of laws affecting land access and rights in achieving gender equity, identifies opportunities for reinforcing environmentally sustainable development through land law reform, and examines from both growth and poverty alleviation perspectives the effectiveness of reforms to formalize property rights and liberalize land markets. The concluding chapter recommends some basic priorities for land law reforms. John W. Bruce is a senior counsel in the Legal Vice-Presidency of the World Bank, and a former director of the Land Tenure Center of the University of Wisconsin-Madison. He has published extensively on land law and land policy in developing countries. Renee Giovarelli, David Bledsoe, Leonard Rolfes, and Robert Mitchell are staff attorneys with the Rural Development Institute of Seattle, Washington, a nonprofit organization that promotes and advises on land-related policy and legal reform in developing and transition countries. All have done fieldwork and advised extensively on land law reform and have published widely on this topic."

Book Land Law Reform in Eastern Africa Traditional or Transformative

Download or read book Land Law Reform in Eastern Africa Traditional or Transformative written by Patrick McAuslan and published by Routledge. This book was released on 2013-06-26 with total page 282 pages. Available in PDF, EPUB and Kindle. Book excerpt: Land Law Reform in East Africa reviews development and changes in the statutory land laws of 7 countries in Eastern Africa over the period 1961 – 2011. The book is divided into two parts. Part 1 sets up the conceptual framework for consideration of the reforms, and pursues a contrast between transformational and traditional developments; where the former aim at change designed to ensure social justice in land laws, and the latter aim to continue the overall thrust of colonial approaches to land laws and land administration. Part 2 provides an in-depth and critical survey of the land law reforms introduced into each country during the era of land law reform which commenced around 1990. The overall effect of the reforms has, Patrick McAuslan argues, been traditional: it was colonial policy to move towards land markets, individualisation of land tenure and the demise of customary tenure, all of which characterise the post 1990 reforms. The culmination of over 50 years of working in this area, Land Law Reform in East Africa will be invaluable reading for scholars of land law, and of law and development more generally.

Download or read book Reform of the Land Laws Conservation of National Resources written by United States Congress and published by Forgotten Books. This book was released on 2018-01-09 with total page 84 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Reform of the Land Laws; Conservation of National Resources: Extracts From Recommendations of the President, the Secretary of the Interior, and the Commissioner of the General Land Office, Etc The boundaries of the national forest reserves unavoidably include certain valuable timber lands not owned by the Government. Im portant among them are the land grants of various railroads. For more than two years negotiations with the land-grant railroads have been in progress looking toward an arrangement by_ which the forest on railroad lands within national forest reserves may be preserved by the removal of the present crop of timber under rules prescribed by the Forest Service, and its perpetuation may be assured by the trans fer of the land to the Government without cost. The advantage of web an arrangement to the Government lies in the acquisition of lands whose protection is necessary to the general welfare. The advantage to the railroads is found in the proposal to allow them to. Consolidate their holdings of timber within forest reserves by ex? Change after deeding their lands to the Government and thus to out within a limited time solid bodies of timber instead of alternate eetions, although the amount of timber in each case would be the same. It is possible that legislation will be required to authorize this or a similar arrangement with the railroads and other owners. If so. I recommend that it be enacted. Book Social Movements Law and the Politics of Land Reform

Download or read book Social Movements Law and the Politics of Land Reform written by George Meszaros and published by Routledge. This book was released on 2013-08-21 with total page 215 pages. Available in PDF, EPUB and Kindle. Book excerpt: Social Movements, Law and the Politics of Land Reform investigates how rural social movements are struggling for land reform against the background of ambitious but unfulfilled constitutional promises evident in much of the developing world. Taking Brazil as an example, it unpicks the complex reasons behind the remarkably consistent failures of its constitution and law enforcement mechanisms to deliver social justice. Using detailed empirical evidence and focusing upon the relationship between rural social struggles and the state, the book develops a threefold argument: first, the inescapable presence of power relations in all aspects of the production and reproduction of law; secondly their dominant impact on socio-legal outcomes; and finally the essential and positive role played by social movements in redressing those power imbalances and realising law’s progressive potentialities.

The book illuminates the key role of legislators, legal consultants and academics in tenure reform.
