In one of the recent Treasury Decisions, Honorable David A. Gates had occasion to remark that unless a public utility like a rail road company earned eight per cent. Upon its investment, its stock could not be kept at par - a conclusion which was reached from an examination of many income tax schedules. In an investigation made in connection with the Fifteen Per Cent. Rate Case, the Illinois Central Railroad Company discovered that in the unusually pros perons year ending June 30, 1916, it had in fact received a return on its investment in road and equipment of only The opin ion oi the Interstate Commerce Commission in this case shows that, taking the railroads of the country as a whole, the return for this same most prosperous year for the carriers in the Eastern Dis trict was Southern District and the Western District The net operating income for 1916 is the largest which the railroads have ever had, and was more than but it was less than 6% upon the Value of the railroad property devoted to_2. But the significant contribution of the new act is the standard directed for measuring total income: In the exercise of its power to prescribe just and reasonable rates, the Commission shall initiate, modify, establish or adjust such rates so that carriers as a whole (or as a whole in each of such rate groups or territories as the Commission may from time to time designate). will, under honest, efficient and economical management and reasonable expenditures for maintenance of way, structures and equipment, earn an aggregate annual net railway operating income equal, as nearly as may be, to a fair return upon the aggregate value cf the railway property of such carriers held for and used in the service of transportation. From a rule of negation designed to protect the railroads from "confiscation" an affirmative program has been evolved. This directs a conscious effort to regulate total railroad earnings. It was a measure of radical inno vation and far - reaching importance, and it ought to have been given a fair test in practical operation for a sufficient length of time. Instead, President Taft, in 1909, felt called upon to propose a new and drastic measure of railroad legislation. He embodied his recommendations on the subject in a bill which was duly introduced in Congress. It was far from being a perfect piece of legislation. The odor of politics was not absent from it. It was considered by the railroads, and in business circles generally, as um called for, unwise, and as unduly burdensome and restrictive in various important respects. But at least it was a consistent and carefully matured meas ure. It was the formal and official expression of the views of the Taft Administration, the second import ant measure put forward by it. It offered the first real test of the capacity for leadership and fighting edge of the President and his Cabinet, and they failed in it lamentably. Book excerpt: Excerpt from The Act to Regulate Commerce: Construed by the Supreme Court The Commerce Clause contains one of the most important grants of power to the United States to be found in the Federal Constitution. Adopted merely for the purpose of preventing disputes among the states which had recently formed the Confederation, it has been the source of varied and potent legislation governing the intricate problems of interstate traffic incident to a complicated and highly developed industrial and social life. Framed to suit the inconsequential problems offered by a traffic handled by stage coach, ox cart and sailing vessel, it has served as the vehicle to govern the important questions arising from an enormous volume of traffic handled by the railroad, the steamer, and other agencies of commerce. A preliminary chapter has been included to trace at least in outline the genesis and development of legislation under the Commerce Clause. The literature of the subject, both political and economic as well as legal, appears to be well nigh inexhaustible. Yet there has seemed room for a further discussion of certain features of the Act to Regulate Commerce. The findings of the Interstate Commerce Commission to date fill some thirty large volumes. The decisions of the lower Federal courts upon this act are only less voluminous. On the other hand, the decisions of the Supreme Court which constitute the last word on the question, and from which no appeal can be taken, have often not been treated by writers on this subject with the measure of importance which should be accorded them. Many of the most important of these decisions have been handed down by that court since the appearance of any treatise on this act. It has seemed desirable, therefore, to collate these decisions, to include an exhaustive discussion of them within the confines of a single volume and to bring them down to the latest possible date. Such a volume could be of particular value to the lawyer who does not have at his disposal a large legal library. It would constitute the law of the Act to Regulate Commerce so far as that law has been finally determined. Decisions of the lower courts, subject to review and, therefore, to being overruled, have been omitted from discussion in this work. It is hoped that the volume will fill a place hitherto unoccupied in the bibliography of the Act to Regulate Commerce.
