Book excerpt: Reducing emissions of carbon dioxide and other greenhouse gases that affect climate change is one of the key challenges facing the international community. The Bank's Prototype Carbon Fund (PCF) provides a framework for action, learning, and research to demonstrate how greenhouse gas emission reduction transactions can contribute to sustainable development, while lowering the costs of compliance with the Kyoto Protocol-the 1997 agreement to cut industrialized world emissions of greenhouse gases. The Latin American and the Caribbean (LAC) Region has a growing number of successful Prototype Carbon Fund (PCF) projects that have yielded useful experience for developing additional projects. This note highlights the lessons learned in the region, to date. The PCF is a public-private fund established in 2000 and administered by the World Bank acting as Trustee. It operates under the clean development mechanism principles of the Kyoto Protocol to the UN Framework Convention on Climate Change (UNFCCC). The PCF aims to demonstrate the potential of market-based mechanisms for reducing the cost of mitigating climate change. It does this by buying Certified Emission Reductions (CERs) from projects that reduce greenhouse gas emissions in Bank client countries, particularly projects that replace fossil fuels with renewable energy sources and those that improve end-use and supply-side efficiency. In return for their shares in the PCF, developed country governments and private sector companies receive CERs, which they can use towards their obligations under the Kyoto Protocol or domestic regulations.

What can governments do to tackle the challenges associated with adapting to climate change? What role can Latin America and the Caribbean play in the area of climate change mitigation? How can the international community best help the region respond? While the study does not attempt to provide definitive answers to these questions, its goal is to contribute new information and analysis to help inform the public policy debate on this important issue.

Book excerpt: Market-based environmental instruments are the most creative of the many initiatives devised to combat air and water pollution and promote biodiversity. Among these, none has attracted more attention than the burgeoning trade in environmental allowances and credits. Originally developed in the United States around 1990, these varieties of tradable instruments were globally validated by the Kyoto Protocol of 1997, which explicitly contemplates the buying and selling of environmental allowances and credits among both sovereign states and corporate entities. Despite U.S. opposition to the Kyoto Protocol, global trading in pollution instruments is growing at an exponential rate, with instruments representing over 70 million tonnes of greenhouse gas emissions estimated to have been traded in 2003. Eco-Finance is the first in-depth legal analysis of this extraordinary hybrid of environmental regulation and global financial markets. It deals with what are currently the two dominant types of market-based environmental instruments: market-traded environmental instruments (which include the tradable pollution allowances envisaged by the Kyoto Protocol), and environmental financing instruments (which include the emerging class of environmental and socially responsible investment funds). Among the numerous topics and issues treated by Ali and Yano are the following: the ?cap-and-trade? regime; debt-for-environment swaps; forestry securitisations; greenhouse gas emissions markets; carbon funds and swaps; tradable green certificates weather derivatives; duty to hedge climatic risks; catastrophe bonds; protected cell companies; the prudent investor rule; and ethical security indices. The authors deal searchingly with the critical legal issues that arise in connection with these market-based environmental instruments, such as the danger that courts might recharacterise underlying risk transfer agreements as illegal insurance products. Book excerpt: Among global environmental issues, climate change has received the largest attention of national and global policy makers, researchers, industry, multilateral banks and NGOs. Climate change is one of the most important global environmental problems with unique characteristics. It is global, long-term (up to several centuries) and involves complex interactions between climatic, environmental, economic, political, institutional and technological pressures. It is of great significance to developing countries as all the available knowledge suggests that they, and particularly their poorer inhabitants, are highly vulnerable to climate impacts. The projected warming of 1. 4 to 5. 8° C by 2100 and the related changes in rainfall pattern, rise in sea-level and increased frequency of extreme events (such as drought, hurricanes and storms) are likely to threaten food security, increase fresh water scarcity, lead to decline in biodiversity, increase occurrence of vector-borne diseases, cause flooding of coastal settlements, etc. Recognizing the potential threat of severe disruptions, the United Nations Conference on Environment and Development was organized in 1992 in Rio de Janeiro, Brazil to begin to address ways to reduce these impacts, which led to the formulation of the UN Framework Convention on Climate Change. This Convention and the subsequent Kyoto Protocol recognize “the common but differentiated responsibility” of developing and industrialized countries in addressing climate change. Developing countries thus have a unique role to play in formulating a sound, reasoned, and well informed response to the threat of climate change.
