Book excerpt: It has been estimated that if every country consumed natural resources at the rate of the UK, we would need three planets to live on. Given this scenario, reducing waste is a key aspect of sustainable development, breaking the link between economic growth and waste growth. This White Paper sets out the Government's policy for waste management in England, building on the progress made since the Waste Strategy 2000 (Cm. 4693-I, ISBN 9780101469326 and Cm. 4693-II, ISBN 9780101469333) was published in May 2000. The main elements of the new strategy are: i) to incentivise efforts to reduce, re-use and recycle waste and recover energy from waste, including increasing the landfill tax escalator and consulting on removing the ban on introducing local household charges to promote waste reduction and recycling; ii) to reform regulation to drive the reduction of waste and diversion from landfill while reducing costs to compliant businesses and the regulator, including introducing waste protocols, consulting on the introduction of further restrictions on the landfilling of biodegradable wastes or recyclable materials, and ensuring effective action on flytipping and on illegal dumping abroad; iii) to target action on materials, products and sectors with the greatest scope for improving environmental and economic outcomes, including promoting producer responsibility through setting packaging standards to reduce excess packaging; iv) stimulate investment in collection, recycling and recovery infrastructure, and markets for recovered materials to maximise their energy value; and v) to improve national, regional and local governance, with a clearer performance and institutional framework to deliver better co-ordinated action and services on the ground, including the establishment of a Defra-led Waste Strategy Board to provide leadership within and across government.

For example, all economic operators placing packaging onto the EU market are responsible for its proper management and recovery. However, in general, the collection and treatment of urban waste is the responsibility of local authorities. It has therefore been necessary to establish a system of financial compensations between producers and waste management operators. Analysing the legal and institutional schemes of several member states and accounting for all the costs and benefits to their local authorities due to selective collection and sorting, this book provides an accurate illustration of how the EPR principle has be translated into practice. Firstly the authors examine whether the industry is paying for the net financial cost of 'preparation for recycling' activities or if the extra-costs of recycling are being recovered via the sale of sorted materials, by the consumer through higher prices or by citizens in general through higher taxes. Secondly, by monetizing the net environmental benefits attained with the recycling system, the book discusses the success and Value-for-Money (VfM) of the EU’s recycling policy. In other words: what is the economic rate of return of the enhanced environmental protection achieved due to the fulfilment of recovery and recycling targets?

As such, it provides a valuable analytical tool in considering how best to pursue cost-effective enforcement. Major themes to be addressed include Becker's deterrence model and expansions thereof, reasons for compliance, environmental enforcement strategies and the importance of a deterrence threat and formal pollution control law enforcement mechanisms such as prosecution and criminal sanctions, administrative mechanisms and civil liability. The book argues that in pursuing cost-effective enforcement much can be learned from examining enforcement practices in different jurisdictions, and to this end the author examines pollution control laws, enforcement strategies and sanctions in Australia, Canada and England and Wales. The book makes an important contribution to existing literature on environmental law enforcement, but its value extends beyond this. The theoretical framework adopted and the range of issues discussed make it of interest to regulatory and public law scholars more generally.
