This work seeks to explain the agunah problem in the United States. It notes that the contemporary agunah problem in America is radically different than that of contemporary Israel and completely different than the talmudic agunah problem. The thesis of this book is that the agunah problem in contemporary America is part of a more general dispute in classical Jewish law as to when marriage should end. Thus, this book surveys how Jewish law seeks to respond to the consent of the other party or without a finding of fault. It concludes by noting that prenuptial agreements can successfully address the agunah problem in the United States since they provide a way for couples to create an image of marriage and divorce by which they can agree to live. Michael J. Broyde is an Associate Professor of Law at Emory University and the Academic Director of Law and Religion Program at Emory University. He is a member (dayan) in the Beth Din of America and was the director of that Beth Din while on sabbatical from Emory. In addition, he is the founding rabbi of the Young Israel synagogue in Atlanta. If he fails to do so, the woman is unable to remarry and is classified as an Agunah until such is obtained. Social and political conditions made it almost impossible for a Jew to make his wife an Agunah when the highly organized and strictly regulated Jewish communal structure was in existence. However, with the break-up of the Jewish community, this enforcement became exceedingly difficult. Rabbis became increasingly aware of women who refused to be thus tied to an ex-husband and remarried without a Get. Moreover, in spite of it being contrary to the Halacha, many could not, in good conscience, condemn a woman who so acted. As a result, the Rabbinical Assembly, by means of its Law Committee, explored the possibility of in some way rectifying the situation. In general, the Committee was concerned with making the change consisted with Halachah. The present paper deals with the various proposals and solutions made between 1930, the year Rabbi Louis Epstein first called attention to the need for action and 1952, the year the "Atlantic City Plan" was outlined."

Clare Chambers shows how feminist and liberal principles require creation of a marriage-free state: one in which private marriages, whether religious or secular, would have no legal status. Part One makes the case against marriage. Chambers investigates the critique of marriage that has developed within feminist and liberal theory. Feminists have long argued that state-recognised marriage is a violation of equality. Chambers endorses the feminist view and argues, in contrast to recent egalitarian pro-marriage movements, that same-sex marriage is not enough to make marriage equal. The egalitarian case against marriage is the most fundamental argument of Against Marriage. But Chambers also argues that state-recognised marriage violates liberty, including the political liberal version of liberty that is based on neutrality between conceptions of the good. Part Two sets out the case for the marriage-free state. Chambers criticizes recent arguments that traditional marriage should be replaced with either a reformed version of marriage, such as civil partnership, or a purely contractual model of relationship regulation. She then sets out a new model for the legal regulation of personal relationships. Instead of regulating by status, the state should regulate relationships according to the practices they involve. Instead of regulating relationships holistically, assuming that relationship practices are bundled together in one significant relationship, the marriage-free state regulates practices on a piecemeal basis. The marriage-free state thus employs piecemeal, practice-based regulation. It may regulate private marriages, including religious marriages, so as to protect equality. But it takes no interest in defining or protecting the meaning of marriage.
