I have not relegated important matter to notes, nor printed on my pages long quotations from other authors or excerpts from original authorities. I have preferred the much more labo rions task of extracting their substance and putting it in my own words into the body of the book, which I trust has gained thereby in both the decrease of bulk and increase of readableness. But I have taken care to provide the means of checking my assertions. At the bottom of nearly every page will be found references, by the use of which teachers and students can amplify or correct the statements in the text and men of aflairs obtain the more detailed information they may want for practical purposes. The notes are, I h0pe, sufficient. My object has been to make them adequate without over loading them with matter. I have not, for instance, referred to a large number of writers of all degrees of authority, when the citation of a few great ones gave the necessary support to my argument; nor have I quoted a dozen cases, when one or two were enough. I have also taken care that most of the cases given in the text should be something more than mere names to my readers. Indeed to prepare men for the duties of citizenship is the chief justification for introducing into education a subject which, on account of its inevitable defect in precision, is less suited as a training for the mind than as an exercise for the trained mind. Again, international law is not a highly technical subject, and it would be a mistake to aim at giving it more technicality by the I mode of treating it. Wigmore, Dean of the Law School of Northwestern University, suggested to the author the preparation of a treatise reflecting what might be called the American conception of international law. That work was then begun. Out of it have grown the present volumes. They em body the results of a study of international law chiefly as it has been interpreted and applied by the United States. They express an attempt primarily to portray what the United States, through the agencies of its executive, legislative and judicial departments, has deemed to be the law of nations. It is not suggested that in legal contemplation there exists an American international law as distinct from that which meces sarily prevails throughout the society of civilized States. It is believed, however, that the views of the Department of State (embracing by implication those of the President), of the Con gress, and of the Courts of the United States, together with those of certain other governmental agencies, give expression to an authentic American understanding of what the principles of international law really are. Such an understanding is entitled to thorough examination and critical analysis; for it constitutes the only scientific basis for the formulation of principles in reliance upon which the United States, Whether at the Hague or elsewhere, may participate intelligently and worthily in the common effort to render the law of nations closely responsive to the just and changing demands of civilization. Clearness of thought concern ing rules which any State may soundly press for adoption in a codification designed for general approval imposes, as a condi tion precedent, an exact enunciation of what are conceived to be the, existing requirements of international law. The scope of the present work necessarily calls for the treat ment of numerous matters which, however closely associated with the international obligations of the United States, refer primarily to the domestic activities of an independent State in pursuance of its fundamental law. Book excerpt: Excerpt from The American Institute of International Law: Its Declaration of the Rights and Duties of Nations The American Institute of International Law, which met at Washington in connection with and under the auspices of the Second Pan American Scientific Congress, adopted on January 6, 1916, a Declaration of the Rights and Duties of Nations. The Declaration differs from other projects of a like kind in that it is not based solely, or indeed at all, upon philosophic principles, but is based exclusively upon decisions of the Supreme Court of the United States. It is therefore fair to say that the principles of the Declaration are, as far as the United States is concerned, the law of the land, and an examination of the practice of the other American countries shows that these principles obtain in each of the American Republics, so that the Declaration is in reality a statement of the fundamental principles of international law, as they are understood in the New World. At the tenth annual meeting of the American Society of International Law, held in Washington, D. C., on April 26, 1916, the Honorable Elihu Root, President of the Society, de voted his opening address to a consideration of the Declara tion, its principles, and their importance.* During the session of the American Institute, the under signed, who happens to be its President, delivered a series of addresses dealing largely with the ideas contained in the pre amble of the Declaration, without which it is incomplete. It has been thought advisable to print the series of addresses, just referred to, in connected form, as an introduction to the Declaration, and to follow it with the official commentary, which the Institute adopted at one and the same time with the text of the Declaration.
