Book The Mental Element

Download or read book The Mental Element written by Kristina Janjac and published by . This book was released on 2014 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Actus non facit reum nisi mens sit rea." --- There can be no criminal responsibility without a subjective relationship that could be defined as intent or negligence (mens rea) of the individual in question towards his actions (actus reus). Regulation of the mental element in the general part of the Rome Statute represents a major step forward in the development of international criminal law, since, so far, none of the statutes of international courts contained general rules on this issue. The focus of this book is Article 30 of the Rome Statute, which contains the default rule on guilt, and defines intent as a basic form of it. Pursuant to the jurisprudence of the ad hoc Tribunals of the United Nations for Yugoslavia and Rwanda, criminal responsibility can be imposed only when both its cognitive and volitional component are fulfilled. For a better comprehension, this book also includes a selection of documents on the "Elements of Crimes." (Series: International Criminal Law - Vol. 9) [Subject: International Law, Criminal Law]

Book Modes of Liability in International Criminal Law

Download or read book Modes of Liability in International Criminal Law written by Jérôme de Hemptinne and published by Cambridge University Press. This book was released on 2019-07-11 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Presently, many of the greatest debates and controversies in international criminal law concern modes of liability for international crimes. The state of the law is unclear, to the detriment of accountability for major crimes and of the uniformity of international criminal law. The present book aims at clarifying the state of the law and provides a thorough analysis of the jurisprudence of international courts and tribunals, as well as of the debates and the questions these debates have left open. Renowned international criminal law scholars analyze, in discrete chapters, the modes of liability one by one; for each mode they identify the main trends in the jurisprudence and the main points of controversy. An introduction addresses the cross-cutting issues, and a conclusion anticipates possible evolutions that we may see in the future. The research on which this book is based was undertaken with the Geneva Academy.

Book General Principles of Thai Criminal Law

Download or read book General Principles of Thai Criminal Law written by Alessandro Stasi and published by Springer. This book was released on 2021-01-06 with total page 156 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is centered around the major issues relating to criminal law in Thailand and aims to offer a detailed and systematic overview of the Thai criminal justice system. It is designed as a traditional textbook of criminal law which provides a succinct focused coverage of all the relevant aspects of laws, judgments, and legal reforms in a concise and readable form. Although all topics have been previously treated in the Thai language, this is the first and most comprehensive work in the English language about Thai criminal law. The book covers not only the legal system, starting from the Penal Code of 1908 and emphasizing the substantial changes that have been introduced in the past decades, but also the deep influence of doctrine and case law. It is built up in several layers, starting from the general rule, to gradually examine the more specific ones. The book begins with the elementary legal concepts to be learned by the reader, by defining the fundamental principles underlying the Thai criminal system and outlining its objectives. It then extensively describes the main offences under the Thai Penal Code and classifies those breaches of law which are crimes from those which are merely illegal without being criminal.

Book Customary International Humanitarian Law

Download or read book Customary International Humanitarian Law written by Jean-Marie Henckaerts and published by Cambridge University Press. This book was released on 2005-03-03 with total page 610 pages. Available in PDF, EPUB and Kindle. Book excerpt: Customary International Humanitarian Law, Volume I: Rules is a comprehensive analysis of the customary rules of international humanitarian law applicable in international and non-international armed conflicts. In the absence of ratifications of important treaties in this area, this is clearly a publication of major importance, carried out at the express request of the international community. In so doing, this study identifies the common core of international humanitarian law binding on all parties to all armed conflicts. Comment Don:RWI.
