Book excerpt: Excerpt from Patents and the Preparation and Prosecution of Applications by Applicants Themselves: A Paper Read March 8, 1917, Before the Examining Corps of the United States Patent Office A patent is a Government grant to an inventor, securing to him for the period of seventeen years the exclusive privilege of making, using and vending and of authorizing others to make, use and vend, any new and useful art, machine, manufacture, or composition of matter, or any new and useful improvement thereof. Patents are also granted for designs but this paper is restricted to the consideration of only such patents as are referred to in the definition just stated. According to Walker on Patents, 4th Edition, paragraph 172: "Letters-Patent are documents consisting of the grant and the specification; and where drawings form a part of the application, they also form a part of the letters-patent. The grant is a paper, issued in the name of the United States, under the seal of the Patent Office, and signed by the Commissioner of Patents. It contains a short title of the invention, and purports to grant to the patentee, his heirs or assigns, for the term of seventeen years, the exclusive right to make, use and vend the invention, throughout the United States and the territories thereof; and it refers to the specification for the particulars of the invention covered by the grant, and each of the three rights granted by letters-patent is a separate substantive right." The author spent fifty years in patent prosecution and teaching to integrate commercial requisites with legal precedent in the preparation of a patent.
