F or this progressive movement, we are mainly indebted to the able decisions, while reviewing the proceedings Of courts-martial, that have issued from the War Department since the establish ment of the office of Judge Advocate of the Army and to the many elaborate Opinions by the Attorneys General, on points of law requiring legal interpretation. These decisions and opiu ions, presenting, as they do, authoritative information of nu usual interest to the army at large and not generally accessible, first suggested the preparation of a work in which they might be embodied. The suggestion lost none of its force, in view Of the fact, that for the instruction of the Cadets of the Military Academy in the practice of courts-martial, this most essential information was not to be found in their text-book. This volume has been the result of much careful investiga tion, and the hope is entertained that it may contribute a use ful link in the chain of our military jurisprudence. It was an era of religious rather than civil agitation; foreign wars, involving important military operations on land, were infrequent, and the policy of the Govern ment, especially during the long reign of Elizabeth, was one of internal and economic development, and of neutrality or non-interference in foreign affairs. The result was to defer the discussion of purely constitutional ques tions, and to delay the final distribution of sovereign powers between the legislative and executive departments of the government for more than a century. During this epoch, however, Englishmen were not permitted to forget the existence of martial law; although the occasions for its exercise were less frequent than they had been during the disturbed reigns of the Houses of Lancaster and York, and were, perhaps, more nearly justified by the facts of existing emergencies than was the case during the first half of the period of Stuart rule. It will facilitate an understanding of the scope and effect of the revision to refer to the history and development of the amended Code of 1874, indicate briefly its most serious defects, and summarize the principal changes introduced by the revision. History of United States Articles of War Prior To 1916. Passing over the earlier enactments of the American Colonies of Articles of War for the government of their respective forces, examples of which are found in the articles adopted by the Provisional Congress of Massachusetts Bay, April 5, 1775(Am. Archives, 4th series, vol. 1, p. 1350), and the similar articles adopted in May and June of that year by the Provincial Assemblies of Connecticut and Rhode Island and the Congress of New Hampshire (idem, vol. 2, pp. 565, 1153, 1180), we come (a) to the first American articles enacted by the Second Continental Congress June 30, 1775, and copied largely from the British Code of 1765 and the Massachusetts Code; (b)the Code of 1776, an enlargement and modification of the Code of 1775; and (c) the supplemental Code of 1786, regulating the composition of courts-martial and generally the administration of military justice. The articles in force on the adoption of the Constitution of the United States were, by act of the First Congress, made to apply to the then existing Army "so far as the same are applicable" and were continued in force by successive enactments until April 10, 1806, when, by act of Congress of that date, revised articles, adapted to the changed form of government, were enacted, superseding all other enactments on the same subject. Thus the Code of 1806 was, in effect, a reenactment of the articles in force during and immediately following the period of the Revolutionary War, with only such modifications as were necessary to adapt them to the Constitution of the United States. The judge advocate read to the court the following letters: - Letter from general Hampton to colonel Gushing, dated 18th February, 1811. Letter from the same to colonel Covington, dated 20th February, 1811. Letter from colonel Cushing to general Hampton, dated 4th March, 1811. Letter from colonel Covington to colonel Cushing, dated 18th March, 1811. Colonel's answer, of same date. The court, upon consideration, determined that colonel Cushing is in arrest. Colonel Cushing then stated to the court that he was not ready for trial, and requested the indulgence of the court until tomorrow, to show cause, &c. The court granted his request, and adjourned, to meet again tomorrow at 9 o'clock. The court met pursuant to adjournment. All present. The court determined to be formed and organized prior to their deciding on colonel Cushing's motion for postponement. The judge advocate accordingly demanded of the accused, whether he had any objection against, or challenge to make of, any of the members composing the court, and, if any, to slate them as their names were mentioned. Book excerpt: Excerpt from The Duties of a Judge Advocate: In a Trial Before a General Court-Martial, Compiled From Various Works on Military Law It has been found that many of those appointed to fill the very important position of Judge Advocate, however well versed in general knowledge and legal attainments, are, nevertheless, deficient in those points of practice and clerical nicety which are requisite in the proper prepara tion of the proceedings of a general court-martial. Many excellent works are extant, and from them can be obtained all the information that could be desired; but these works are now difficult to be procured, and an officer in the field, called upon, for the first time, to discharge the responsible and multifarious duties of Judge Advocate, feels at a loss, unaided by them, to know how those duties are to be con ducted. To meet this want, the following treatise has been pre pared. The main object in its compilation has been to pre sent a brief, though at the same time comprehensive, dirce tion for the management of a case from its inception to its close; with the proper method of recording the several points likely to arise during the trial. It is presumed that the Judge Advocate is already fully instructed in the rules of evidence, the general principles of law, and the practice of criminal courts; and, therefore, those subjects are scarce ly touched upon.
