Book excerpt: Excerpt from The Constitutional Duty of the Federal Government to Abolish American Slavery: An Expose of the Position of the Abolition Society of New-York City and Vicinity We mean that slaveholding is illegal, as other criminal practices are illegal We affirm that there is no legislation in any of the States that makes it legal. We maintain that, even without any legislation against slavery, it is now the right and duty of the Courts of Justice to liberate any slave who may bring a suit for his or her freedom. Why Slavery is Illegal. We affirm its illegality on two general grounds: First, Slavery can not possibly be legalized. Second, If it could be, it never has been, and is not now, legalized in this country. The ground first mentioned is that of an universal and immutable principle; the second is that of history, and of existing local fact. First, Slavery can not possibly be legalized. In its very nature it is incapable of legalization. The standard writers on common law affirm the impossibility of legalizing slavery, even by positive municipal law. They declare the right to liberty to be inalienable, and that statutes against fundamental morality are void. The nature of civil government and of civil law, as defined by all standard writers on those subjects, proves it impossible to legalize slavery. "To secure" man's inalienable rights, "governments are instituted among men." And consequently they can have no lawful authority to violate the rights which they exist only to protect. Book excerpt: Excerpt from On the Government of the Territories: The Constitutional Power of the General Government and the People in the Federal Territories Another claim for this power of intervention has been set up through the medium of the Judicial Tribunals. It. Is said that the Supreme Court, in the Dred Scott case, having declared slaves to be property, (a proposition never denied by a lawyer, ) the Constitution protects property in the Territories. Grant it; but the Constitution does not create property, nor determine what property is. Nor does the Constitution extend more protection to property in the Territories than in the States. If, then, the right of property enables, by virtue of the Constitution, a mas ter to carry his slave into a Territory and be protected against the local law, it equally enables him to carry such slave into a State, and be protected there against the local Constitution or laws of the State; for the Federal Constitution is the Supreme law of the land, and the Judges in every State shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding. If the Constitution then enables Congress to protect slaves when carried into a Territory because they are property, it equally enables that body, for the same reason, to protect them when carried into any State. The pro perty in the slave is the creature of some law or legal recogni tion of the State from which he came, and if this property is pro tected against the local law of prohibition in one place it must be in another: or else the Constitution has greater force in one part of the land over which it is the supreme law than in another. But the inference drawn from the Dred Scott case is not justified by the case itself, and it need be referred to no further. Book excerpt: Excerpt from The Rights of the Free States Subverted: Or, an Enumeration of Some of the Most Prominent Instances in Which the Federal Constitution Has Been Violated by Our National Government for the Benefit of Slavery This communication was sent to the Senate and House of Representatives by the President on the 12th January following, but no final action appears to have taken place at that timed; On the 29th of June, 1796, another treaty was entered into between the United States and the Creek Indians, called the treaty of Coleraine. Ey, 'the terms of this latter treaty, the Indians again covenanted to deliver up to the officers of the U. States, such negroes as were resident in their nation; and if they were not delivered by the first day of January next following the date of the treaty, then the Governor of Geor gia was authorized to appoint three persons to repair to the Creek nation and demand said negroes, under direction of the President of the United States. In consideration of this, and other stipulations, the United States covenanted to pay the Indians six thou sand dollars in goods, and to furnish them with two blacksmiths and strikers, tools, &c., 850. Thus were the people of the free States again involved in the expense and disgrace of sustaining slavery, for the sole benefit of the slaveholders of Georgia. It should also be understood, that at the conclusion of this treaty, many of the slaves from the Upper Creek towns were brought in and delivered to the officers of Government, who con descended to act with the Indians as the assistant catchpolls of southern slaveholders. Thus were the people of the whole nation taxed and again dishonored for the benefit pf an institution most palpably beyond the jurisdiction of the Federal Government, and abhorrent to the feelings of the people generally. They recognized the principle of universal abolition, in their proceeding with respect to the North West Territory; of which proceed ing the history and import are especially worthy of atten tion. The whole territory north of the river Ohio, and west of the state of Pennsylvania, extending northwardly to the northern boundary of the United States, and westwardly to the Mississippi, was claimed by Virginia. The states of Massachusetts and Connecticut claimed all that part which was within the breadth of their respective charters, and the state of New York had also an indeterminate claim to the country. As early as the year 1780, Congress recommended to all the states whose charters included ungranted ter ritory, to cede it to the Union for national purposes; and the states without such territory, always contended that the lands gained by the common exertions, were or ought to be common propertyflr Some of the smaller withheld their ratification of the articles of confederation, in order to compel the cession for which they called as matter of right; and finally they carried their point.
