It argues that the rise of penal populism can be attributed to social, economic and political changes that have taken place in New Zealand since the postwar years. These changes undermined the prevailing penalwelfare logic that had dominated policymaking in this area since 1945. It examines the way in which 'the public' became more involved in the administration of penal policy from 1999 to 2008. The credibility given to a law and order referendum in 1999, which drew attention to crime victims and 'tough on crime' discourse, exemplified their new role. In its aftermath, greater influence was given to the public and groups speaking on its behalf. The referendum also influenced political discourse in New Zealand, with politicians increasingly using 'tough on crime' policies in election campaigns as it was believed that this was what 'the public' wanted when it came to criminal justice issues. As part of these developments, the thesis examines the rise of the Sensible Sentencing Trust, a unique law and order pressure group that advocates for victims' rights and the harsh treatment of offenders. The Trust became an increasingly authoritative voice in both the public and political arena, as public sentiments came to overrule expert knowledge in the administration of penal policy. Ultimately, it argues that the power of penal populism is so strong in New Zealand that attempts to resist it are likely to come to little, unless these forces that brought it to prominence can be addressed and negated. To date, this has not happened.

Green explores the reasons underlying the vastly differing responses of the English and Norwegian criminal justice systems to the cases of James Bulger and Silje Redergard respectively. Whereas James Bulger's killers were subject to extreme press and public hostility, and held in secure detention for nine months before being tried in an adversarial court, and served eight years in custody, a Redergard's killers were shielded from public antagonism and carefully reintegrated into the local community. This book argues that English adversarial political culture creates far more incentives to politicize high-profile crimes than Norwegian consensus political culture. Drawing on a wealth of empirical research, Green suggests that the tendency for politicians to justify punitive responses to crime by invoking harsh political attitudes is based upon a flawed understanding of public opinion. In a compelling study, Green proposes a more deliberative response to crime is possible by making English culture less adversarial and by making informed public judgment more assessable.

It adopts an historical approach to examine the development of risk control measures used across the US, UK, New Zealand, Australia and Canada - particularly since the 1980’s - with the rise of the "security sanction". It also takes a criminological and sociological approach to analysing shifts in criminal law and punishment and its implications for contemporary society and criminal justice systems. Law, Insecurity and Risk Control analyses the range and scope of the ‘security sanction’ and its immobilizing measures, ranging from control over minor incivilities to the most serious crimes. Despite these innovations, though, it argues that our anxieties about risk have become so extensive that the "security sanction" is no longer sufficient to provide social stability and cohesion. As a consequence, people have been attracted to the ‘magic’ of populism in a revolt against mainstream politics and organisations of government, as with the EU referendum in the UK and the US presidential election of Donald Trump in 2016. While there have been political manoeuvrings to rein back risk and place new controls on it, these have only brought further disillusionment, insecurity and anxiety. This book argues that the "security sanction" is likely to become more deeply embedded in the criminal justice systems of these societies, as new risks to both the well-being of individuals and the nation state are identified.
