The absence of a functioning government in Somalia remains the single greatest challenge to regional security and provides freedom of action for those engaged in piracy along the Somali coast. Some observers also have alleged that the absence of coastal security authorities in Somalia has allowed illegal international fishing and maritime dumping to occur in Somali waters, which in turn has undermined the economic prospects of some Somalis and may be providing economic or political motivation to some groups engaged in piracy. The apparent motive of many active Somali pirate groups is profit, and piracy has proven to be a lucrative activity for many thus far. Beginning in January 2009, the Obama Administration signalled its intention to continue working with U.S. partners in the Contact Group on Somalia and the Contract Group on Piracy off the Coast of Somalia. Enhanced diplomatic engagement with Somali Transitional Federal Governmental officials and leaders from the semi-autonomous region of Puntland also will be launched with the aim of encouraging local Somalis to take steps to secure regions where pirates currently enjoy safe havens. This book consists of public documents which have been located, gathered, combined, reformatted, and enhanced with a subject index, selectively edited and bound to provide easy access.

It identifies key factors that are responsible for the development of Somali piracy and the actors which aim to stop it. Furthermore, the report addresses the legal, social, militaristic, economic, and political complications that arise from varying international strategies to effectively combat policy. The report outlines several underlying historical and geographical factors followed by the impacts that Somalia has faced in terms of its central government’s collapse in 1991. As is discussed, Somalia as a failed state has allowed for piracy to flourish in conjunction with the described underlying factors. It also describes the cyclical trend, or feedback loop, that many of these factors have for promoting piracy while piracy in return antagonizes the issues caused by these factors. The obstacles towards combating piracy are also discussed demonstrating the difficult scenario that policymakers will need to address in order to effectively treat the cause of piracy. In order to identify the contradiction that exists pertaining to the issue of Somali piracy, this report will focus on Somalia’s fractured society and its incompatibility with international democratic norms. As will become evident, the reduction of piracy hinges on the ability for Somalia’s central government to stabilize. A couple of weeks ago yet another ship has been captured. According to the International Maritime Organization (IMO) data, there had been more pirate attacks reported in the first quarter of 2009 than in the entire previous year, whereas Somali pirates had undertaken half of those. It seems as if the twenty-first century is competing against the seventeenth. Put differently, combating piracy off the Somali coast might now be considered an analogy to the fight against international terrorism following September 11. Being considered a rather regional problem so far, piracy off the coast of Somalia has taken on international implications since more than 20,000 ships a year are passing Somali waters carrying about 8 % of the world’s trade of goods and commodities. This very important route – through the Gulf of Aden – is threatened continuously by pirates affecting international commercial shipping, fishing and humanitarian aid supply. In the first step this paper will introduce the region as well as the setting of the crisis and offer a pragmatic definition of the act of piracy. Subsequently it will outline the extent to which the crisis causes significant concerns and point out its impact not only on Somalia but also on international trade, the environment and security; altogether stirring vitally important areas of international freedom. In the second step it will cover the actions taken by the international community, especially the United Nations Organizations, and approach proposals to resolve the conflict. The consequential arguments represent the bridging to the third part which will summarize the points at issue and conclude with questions offering incentives to alternative approaches.

From almost the beginning of state-sponsored navies, piracy suppression has been one of their major responsibilities -- when Julius Caesar was captured by pirates in 76 BCE, the first thing he did after paying the pirates' ransom and being released was to fit "out a squadron of ships to take his revenge." Despite piracy's importance and the continued frequency of piratical attacks, however, relatively few scholarly works have been written analyzing cases of modern piracy and piracy suppression in terms of varying strategic, policy, and operational decisions. This edited collection of case studies attempts to fill this gap. There have been a number of important historical studies that have dealt with the subjects of piracy and piracy suppression. Books written from the point of view of those wishing to end piracy have tended to focus on legal issues, including the rights of victims, the procedures and decisions of Admiralty courts in punishing pirates, and the capture of piracy ships as prizes. Others have looked at the existence of piracy in terms of one particular place or time period, with the Barbary Coast and the Caribbean Sea claiming disproportionate shares of attention. Pirates are often romanticized; Forbes magazine has recently listed history's top-earning pirates, including Samuel "Black Sam" Bellamy at US$120 million (2008 dollars), Sir Francis Drake at US$115 million, and Thomas Tew at US$103 million. More famous pirates, like Edward Teach (Blackbeard), came in far down the list, at tenth place, with only US$12.5 million.

Piracy in the Strait of Malacca region once ran rampant, but has steadily declined since 2003. It seems useful to apply the counter-piracy tactics used in this region to the Gulf of Aden area to attempt a decline in pirate attacks. An attempt to apply the counter-piracy tactics used in the Malacca region to the Gulf of Aden region will fail. The Strait of Malacca littoral states all have well-functioning, established governments which give them the ability to apply the rest of their counter-piracy "formula" of state-sponsored naval forces, regional intelligence sharing, surface surveillance radars, a court system and fighting the origins of piracy on land. The governments in the Gulf of Aden region are too preoccupied with political or economic strife to deal with counter-piracy. Until governmental stability is achieved, few counter-piracy tactics will prevail. Foreign forces have come to the aid of the region. These forces are enforcing the applications of the formula to compensate for the inability of the weaker governments to do so. This is the short-term solution until governmental stability is achieved in the region, giving the indigenous states the ability to police their own waters and enforce their own laws. Recommendations include U.N. Security Council Resolutions or agreements with littoral states to pursue pirates in their territorial waters or in the pirate havens ashore, and coordinated planning between USAFRICOM and USCENTCOM for combining the land and sea counter-piracy tactics.
