Book Planning Law and Practice in Northern Ireland

Download or read book Planning Law and Practice in Northern Ireland written by Stephen McKay and published by Taylor & Francis. This book was released on 2022-10-24 with total page 475 pages. Available in PDF, EPUB and Kindle. Book excerpt: Each of the jurisdictions within the United Kingdom is constantly refining the operational characteristics of its planning system and while there are some common practices, there are also substantive divergences. In each territory the planning template is shaped within a dynamic political and legal context and thus students and practitioners require an accessible, in-depth and up-to-date literature dealing with this matter. The multi-disciplinary contributors to this expanded Second Edition of Planning Law and Practice in Northern Ireland explore the progression of planning within the region and discuss prominent facets of contemporary development management, development plans, environmental law, property law and professional practice. Consideration is given to the consequences of Brexit for planning in Northern Ireland, devolved government institutional structures for planning, and the post-2015 emergent performance of local authorities in this arena. The book makes an important contribution to the wider literature in this field and, with its extensive citing of statutes and cases, provides an essential resource for students, planning practitioners and researchers.

Available in PDF, EPUB and Kindle. Book excerpt: Planning is at the heart of the response to many of the significant challenges of our time, from the climate and environmental crises to social and economic inequalities. It is embedded in, as well as partially constituting, our democratic systems, so that the challenges of democratic decision-making in a complex society cannot be avoided when thinking about planning. Planning law raises some of the most fundamental questions faced by legal scholars, from the legitimacy of authority to the relationship between public and private rights and interests. And yet, planning law has been relatively neglected by legal scholars. The objective of Taking English Planning Law Scholarship Seriously is to create space for planning law scholarship in all of its variety, and for curiosity about law in all its complexity. The chapters reflect this diversity and complexity, covering a range of the objects of planning (from housing to energy to highways) and a multiplicity of planning tasks and tools (from compulsory purchase to contracting to planning inquiries).

Available in PDF, EPUB and Kindle. Book excerpt: Land Use Law in Florida presents an in-depth analysis of land use law common to many states across the United States, using Florida cases and statutes as examples. Florida case law is an important course of study for planners, as the state has its own legal framework that governs how people may use land, with regulation that has evolved to include state-directed urban and regional planning. The book addresses issues in a case format, including planning, land development regulation, property rights, real estate development and land use, transportation, and environmental regulation. Each chapter summarizes the rules that a reader should draw from the cases, making it useful as a reference for practicing professionals and as a teaching tool for planning students who do not have experience in reading law. This text is invaluable for attorneys; professional planners; environmental, property rights, and neighborhood activists; and local government employees who need to understand the rules that govern how property owners may use land in Florida and around the country.

Book Planning for Wicked Problems

Download or read book Planning for Wicked Problems written by Dawn Jourdan and published by Routledge. This book was released on 2015-10-23 with total page 268 pages. Available in PDF, EPUB and Kindle. Book excerpt: Efforts to teach students pursuing graduate degrees in urban and regional planning are often frustrated by the "case books" that have been prepared for use by law professors teaching similar courses. Dawn Jourdan and Eric J. Strauss have attempted to take their concerns to heart in the design of this Planning for Wicked Problems: A Planner's Guide to Land Use Law. Each chapter begins with a planning problem that is complex and has no "correct" answer. Students should answer this hypothetical before reading the subsequent sections of each of the chapters. The second section of each chapter provides a primer for each topic. This primer is meant to summarize the basic principles of the law and to identify the types of questions relevant to planners when such issues arise. The third section of each chapter includes a series of edited court opinions. The cases selected have been identified by American Institute of Certified Planners as those fundamental to planning education. Each chapter concludes with an answer to the proposed wicked planning problem. Planning for Wicked Problems has been written to demonstrate to future planners how the law may be a useful tool in helping them invent solutions to wicked planning problems. The book features a companion website for additional study and review.

Book The Anatomy of Administrative Law

Download or read book The Anatomy of Administrative Law written by Joanna Bell and published by Bloomsbury Publishing. This book was released on 2020-05-28 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Winner of the 2022 Inner Temple New Authors Book Prize. This book seeks to further our understanding of the nature of administrative law doctrine and adjudication. It has three main aims. The first is to improve understanding of administrative law's 'anatomy' by pulling the subject apart and exploring the nature of the legal structures at play in adjudication. In doing so, the book emphasises three main ways in which administrative law's anatomy is both complex and diverse, namely: - administrative law doctrine interacts with a broad array of legislative frameworks; - administrative law adjudication seeks to accommodate a variety of legal values; and, - administrative law is concerned with legal relationships of different kinds. The second aim is to illustrate the importance of recognising the complexity and variety of administrative law's anatomy in three particular doctrinal contexts: procedural review, legitimate expectations and standing. The third and final aim is to raise an important but under-explored question: is it plausible and useful to attempt to make sense of administrative law doctrine by reference to a singular organising concept or principle? The overarching message of the book is one of cynicism. The complexity and variety of administrative law's legal structures probably means that attempts to explain the field 'monistically', while they may capture important themes, will be unhelpfully reductionist. Ambitious and thought-provoking, this is an important new statement on administrative law.
