Download or read book Planning Act 2008 written by U K Stationery Office and published by The Stationery Office. This book was released on 2008-12 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: Parts 1 to 8 of the Planning Act 2008 create a new system of development consent for nationally significant infrastructure projects. The new system covers certain types of energy, transport, water, waste water and waste projects. The number of applications and permits required for such projects is being reduced, compared with the position under current legislation. A major role in the new system is to be played by a new independent body to be called the Infrastructure Planning Commission ('the Commission'). The Commission will be responsible for examining applications for development consent for nationally significant infrastructure projects. National policy statements will set the framework for decisions by the Commission. The Secretary of State will have a wide discretion as to how prescriptive the policy should be. The Act sets out the procedures for examination of an application. It is intended that in examining applications greater use is made of written representations with less reliance on oral representations; and restrictions are being placed on the use of cross examination by interested parties at a hearing. The Act sets a timetable for examination of applications and decisions. A deadline of six months is stipulated for carrying out the examination procedure and a further three months is allowed for a Council (consisting of between five and nine Commissioners), a Panel or the Secretary of State to take a decision. Part 9 of the Act makes various alterations to the existing town and country planning regime. Part 10 adds certain matters within the field of town and country planning to the legislative competence of the National Assembly for Wales. Part 11 empowers the Secretary of State to establish a Community Infrastructure Levy.

Book Legal Foundations of Land Use Planning

Download or read book Legal Foundations of Land Use Planning written by Jerome G. Rose and published by Routledge. This book was released on 2017-07-12 with total page 561 pages. Available in PDF, EPUB and Kindle. Book excerpt: Urban planning is a community process, the purpose of which is to develop and implement a plan for achieving community goals and objectives. In this process, planners employ a variety of disciplines, including law. However, the law is only an instrument of urban planning, and cannot solve all urban problems or meet all social needs. The ability of the legal system to implement the planning process is limited by philosophical, historical, and constitutional constraints. Jurisprudence is concerned with societal values and relationships that limit the effectiveness of the law as an instrument of urban planning. When law is definite and certain, freedom is enhanced within the boundaries created by the law. This doctrine of Anglo-American law imposes an obligation on courts to be guided by prior judicial decision or precedents and, when deciding similar matters, to follow the previously established rule unless the case is distinguishable due to facts or changed social, political, or economic conditions The author focuses on seven specific areas of law in relation to land use planning: law as an instrument of planning, zoning, exclusionary zoning and managed growth, subdivision regulations, site plan review and planned unit development, eminent domain, and the transfer of development rights. Jerome G. Rose cites more than one hundred court cases, and the indexed list serves as a useful encyclopedia of land use law. This is a valuable sourcebook for all legal experts, urban planners, and government officials.

Outlining land use, urban planning, and environmental protection policies, this fully illustrated book explains the nature of the planning process and the way in which policy issues are identified, defined, and approached. The new edition incorporates new planning legislation and regulations at the state and federal layers of government and examples of local ordinances in a variety of planning areas. New material includes discussions of • education and equity in planning; • the City Beautiful Movement; • Daniel Burnham’s plan for Chicago; • segregation; • Knick v. Township of Scott; • reforming single-family zoning and regulatory challenges in zoning and land use; • Daniel Parolek’s ‘Missing Middle Housing’; • climate change, mitigation, adaptation, and resiliency; • the drinking water crisis in Flint, Michigan; • sharing programs for cars, bicycles, and scooters; • hybrid electric and autonomous vehicles; • Vision Zero; • COVID-19 relief for housing; • Innovation Districts, Promise Zones, and Opportunity Zones; • the sharing, gig, and creative economies; • scenic views and vistas, monuments, statues, and remembering the past; and • healthy cities, Health Impact Assessment, and active living. This detailed account of urbanization in the United States reveals the problematic nature and limitations of the planning process, the fallibility of experts, and the difficulties facing policy-makers in their search for solutions.
