Because of various activities and duties, my contribution to the general conception of this volume has only been formal, and all the credit for it is due to Ole Hagen. I should also emphasize that the responsibility for the year's delay in the publishing of this volume is entirely mine, for two reasons. First of all, I have been involved in many works in very different fields. Second, the English translation of my 1943 contribution to the concept of cardinal utility took some time. The points of view the reader will find in this volume are often different and sometimes contradictory, but this can only increase the interest of its reading. In any case, this is not the editors' part to side with or against. Thus contributions to this volume are presented as they have been submit ted to the editors. Recently the American School of utility, founded by von N eumann Morgenstern, encountered a far-going criticism by the French School of utility represented by its founder Allais. The whole basis of the theory of decisions involving risk has been shaken and put into question. Consequently, basic research in the fundamentals of utility and value theory evolved into a crisis. Like any crisis in basic research, and this one was not an exception, it was very fruitful. One may simply say: Allais versus von Neumann-Morgenstern, or the French School of utility versus the American School, became one of the battlefields of scientific development which proved to be a most creative source of new advances and new developments in all those sciences which are based on evaluation of utilities.

Book excerpt: 1.1 Utilitarian Theories This book is a monograph on moral philosophy and social philosophy, particularly the part of the philosophy of economics that is related to the general distribution problem. It presents a comprehensive ethical theory, together with an application of the theory to distributive justice. The viewpoint of this theory is utilitarian. However, this theory is different in some crucial points, as well as in minor details, from all existing forms of utilitarianism. Moral philosophy deals essentially with the moral judgment of actions, i. e., whether a moral action is right or wrong, good or bad. The judgment is usually based on a line of logical reasoning, which can be traced to a final reason called the justification or ultimate principle. An ethical theory is a self-consistent system built upon a basic, or ultimate, principle. An ultimate principle can never be rigorously proven, and is not unique. Different philosophers establish different ethical theories upon different principles. Therefore, in the history of development of moral philosophy, there have been a large number of ethical theories and schools. Even wi thin the same school having the same ultimate principle, different philosophers may have different versions of the theory, because of small variations in the interpretation of the ultimate principle or in the elaboration of the details.

Prindle also evaluates political, economic, and legal ideas through the lens of his own beliefs. He warns against the emerging extremes of liberal ideology in contemporary American politics, where the right's definition of capitalism excludes interference from democratic publics and the left's definition of democracy excludes a market-based economy.

Given these high stakes, Robert Cooter argues that constitutional theory should trouble itself less with literary analysis and arguments over founders' intentions and focus much more on the real-world consequences of various constitutional provisions and choices. Pooling the best available theories from economics and political science, particularly those developed from game theory, Cooter's economic analysis of constitutions fundamentally recasts a field of growing interest and dramatic international importance. By uncovering the constitutional incentives that influence citizens, politicians, administrators, and judges, Cooter exposes fault lines in alternative forms of democracy: unitary versus federal states, deep administration versus many elections, parliamentary versus presidential systems, unicameral versus bicameral legislatures, common versus civil law, and liberty versus equality rights. Cooter applies an efficiency test to these alternatives, asking how far they satisfy the preferences of citizens for laws and public goods. To answer Cooter contrasts two types of democracy, which he defines as competitive government. The center of the political spectrum defeats the extremes in "median democracy," whereas representatives of all the citizens bargain over laws and public goods in "bargain democracy." Bargaining can realize all the gains from political trades, or bargaining can collapse into an unstable contest of redistribution. States plagued by instability and contests over redistribution should move towards median democracy by increasing transaction costs and reducing the power of the extremes. Specifically, promoting median versus bargain democracy involves promoting winner-take-all elections versus proportional representation, two parties versus multiple parties, referenda versus representative democracy, and special governments versus comprehensive governments. This innovative theory will have ramifications felt across national and disciplinary borders, and will be debated by a large audience, including the growing pool of economists interested in how law and politics shape economic policy, political scientists using game theory or specializing in constitutional law, and academic lawyers. The approach will also garner attention from students of political science, law, and economics, as well as policy makers working in and with new democracies where constitutions are being written and refined.
