Available in PDF, EPUB and Kindle. Book excerpt: Classic Books Library presents this brand new edition of “The Federalist Papers”, a collection of separate essays and articles compiled in 1788 by Alexander Hamilton. Following the United States Declaration of Independence in 1776, the governing doctrines and policies of the States lacked cohesion. “The Federalist”, as it was previously known, was constructed by American statesman Alexander Hamilton, and was intended to catalyse the ratification of the United States Constitution. Hamilton recruited fellow statesmen James Madison Jr., and John Jay to write papers for the compendium, and the three are known as some of the Founding Fathers of the United States. Alexander Hamilton (c. 1755–1804) was an American lawyer, journalist and highly influential government official. He also served as a Senior Officer in the Army between 1799-1800 and founded the Federalist Party, the system that governed the nation’s finances. His contributions to the Constitution and leadership made a significant and lasting impact on the early development of the nation of the United States.

Book The Constitutional Convention of 1787

Download or read book The Constitutional Convention of 1787 written by Stuart Leibiger and published by . This book was released on 2023 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This history of the 1787 Constitutional Convention uses a chronological narrative format to capture the complexity, messiness, and unfolding daily drama behind the writing of the U.S. Constitution, as well as the role of contingency in that process. The Framers of the U.S. Constitution designed a novel republican form of government to replace the failing Confederation, one that would divide power between the federal government and the states, launching a new phase of the American "experiment" in representative democracy. Not until the end of the American Civil War, nearly a century later, would it become clear, as Abraham Lincoln put it in his Gettysburg Address, "that government of the people, by the people, for the people shall not perish from the earth." The Constitutional Convention of 1787: A Reference Guide provides an invaluable guide covering the background to the convention, the convention itself, the ratification of the Constitution, and the adoption of the Bill of Rights. In addition to the narrative itself, the story of the convention is supplemented with a detailed chronology, a rich selection of primary source documents, 15 biographical sketches of convention delegates, and a comprehensive bibliographical essay. Based largely on primary sources, the book also weighs in on some of the historiographical debates that have taken place among scholars about the convention.

Book excerpt: Since the first and only constitutional convention in 1787, 26 amendments have been added to our governing document, but not one of them became law by virtue of the convention method. Despite more than 400 applications, no constitutional convention has been called in 202 years. Indeed it was James Madison who wrote, "Having witnessed the difficulties and dangers experienced by the first Convention. . . . I should tremble for the result of a Second." In Unfounded Fears: Myths and Realities of a Constitutional Convention, Weber and Perry present a balanced, scholarly look on this controversial topic and introduce surprising conclusions. Weber and Perry seek to determine if, in fact, the first convention was a runaway, as common wisdom holds, and they examine the process by which the Convention was called. They also review the attempts since 1787 to call a second constitutional convention, and they confront many of the questions commonly raised about a potential convention, including the process for electing delegates and the ability of Congress to establish and control the convention's procedures and substance of what a convention does. In their final chapter, they reflect on the realities of a balanced-budget amendment.

Book excerpt: *Includes pictures *Includes contemporary accounts *Includes online resources and a bibliography for further reading "All communities divide themselves into the few and the many. The first are the rich and well born, the other the mass of the people. The voice of the people has been said to be the voice of God; and however generally this maxim has been quoted and believed, it is not true in fact. The people are turbulent and changing; they seldom judge or determine right. Give therefore to the first class a distinct, permanent share in the government. They will check the unsteadiness of the second, and as they cannot receive any advantage by a change, they therefore will ever maintain good government. Can a democratic assembly, who annually revolve in the mass of the people, be supposed steadily to pursue the public good? Nothing but a permanent body can check the imprudence of democracy. Their turbulent and uncontroling disposition requires checks." - Alexander Hamilton, quoted in Notes of the Secret Debates of the Federal Convention of 1787 By 1787, it became evident that the Articles of Confederation were inadequate for the new nation. With these problems hampering the national government under the Articles of Confederation and the threat of default on the nation's massive war debt looming, plans began being made to fix the problems of the Articles of Confederation. Thus, that summer a Constitutional convention was called, and each state sent delegates to Philadelphia. Among the delegates were prominent patriots and former members of the Continental Congress, including George Washington and Benjamin Franklin. However, while most of the delegates came to Philadelphia virtually starting with nothing, Alexander Hamilton and James Madison arrived in Philadelphia well-prepared and well-studied. Hamilton had been a leader in calling for a Constitutional Convention to restructure the nation's government at the convention in Annapolis a year earlier. At that convention, Hamilton had been elected to draft a document describing the reasons for a stronger national government. The letter was sent to each of the 13 states, and it was instrumental in leading to the opening of the Constitutional Convention in 1787. Meanwhile, Madison had been brushing up on his political theory and actually prepared extensively for the Convention. Madison used his extensive knowledge of ancient and foreign languages to study Constitutions from across the world, which he had done this prior to helping craft the Virginia Constitution. Thus, he was already considered something of an expert on Constitutionalism. Given that background, and the fact that he had done more legwork than anybody else at the Convention, delegates looked to him as a leader on the subject. The Constitution was a decisive move away from the Articles of Confederation which the proponents of the Constitution claimed promoted dissonance by giving the States too much autonomy. They argued that a strong federal government ought to be empowered to maintain standing armies, provide for a national militia, and be able to levy direct taxes to support its common defense and provide for economic prosperity. Certain fears about the federal government becoming omnipotent and abusing its military authority or right to tax, they argued, should be assuaged by understanding the role of legislature, or the representatives of the people, in determining the central government's authority to raise an army and levy taxes. This was a democratic experiment that had never been embarked upon before. The Constitutional Convention of 1787: The History and Legacy of the Drafting of the U.S. Constitution looks at how America's governing document came to be. Along with pictures of important people, places, and events, you will learn about the Constitutional Convention like never before.

Book The Article V Convention for Proposing Constitutional Amendments

Download or read book The Article V Convention for Proposing Constitutional Amendments written by Thomas H. Neale and published by Createspace Independent Pub. This book was released on 2012-12-02 with total page 28 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Philadelphia Convention of 1787 provided two methods of proposing amendments to the U.S. Constitution. In the first, Congress, by two-thirds vote in both houses, proposes amendments to the states. If three-fourths of the states (38 at present) vote to ratify the amendment, it becomes part of the Constitution. Since 1789, Congress has proposed 33 amendments by this method, 27 of which have been adopted. In the second method, if the legislatures of two-thirds of the states (34 at present) apply, Congress must call a convention to consider and propose amendments, which must meet the same 38-state ratification requirement. This alternative, known as the Article V Convention, has not been implemented to date. Several times during the 20th century, organized groups promoted a convention that they hoped would propose amendments to the states, or to “prod” Congress to propose amendments they favored. The most successful was the movement for direct election of Senators, which helped prod Congress to propose the 17th Amendment. The most recent, which promoted a convention to consider a balanced federal budget amendment, gained 32 applications, just two short of the constitutional threshold. When the balanced budget amendment campaign failed in the 1980s, interest in the convention option faded and remained largely dormant for more than 20 years. Within the past decade, interest in the Article V Convention process has reawakened: several policy advocacy organizations have publicized the Article V Convention option, particularly as an alternative to what they portray as a legislative and policy deadlock at the federal level. An important issue in the contemporary context is the fact that advances in communications technology could facilitate the emergence of technology-driven issue advocacy groups favorable to this phenomenon. The rise of instant interpersonal communications, email, and other social media helped facilitate the rapid growth of such groups as MoveOn.org, the Tea Party movement, and, most recently, Occupy Wall Street. These tools could be harnessed to promote a credible campaign in a much shorter time than was the case with previous convention advocacy movements. Reviewing the history of the Article V Convention alternative, the record of the Constitutional Convention of 1787 clearly demonstrated the founders' original intent. During the convention, they agreed that a second mode of amendment was needed to balance the grant of amendatory power to Congress. This method, clearly identified in Article V as co-equal to congressional proposal of amendments, empowered the people, acting through their state legislatures, to summon a convention that would have equal authority to propose an amendment or amendments, which would then be presented to the states for ratification. Only the states can summon an Article V Convention, by application from their legislatures. Some of the issues concerning this process include procedures within the state legislatures; the scope and conditions of applications for a convention; steps in submitting applications to Congress; and the role of the state governors in the process. This report identifies and examines these issues.
