Book The Economic Constitution

Download or read book The Economic Constitution written by Tony Prosser and published by . This book was released on 2014 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: There has been little analysis of the constitutional framework for management of the UK economy, either in constitutional law or regulatory studies. This is in contrast to many other countries where the concept of an 'economic constitution' is well established, as it is in the law of the European Union. Given the extensive role of the state in attempting to resolve recent financial crises in the UK and elsewhere in Europe, it is particularly important to develop such an analysis. This book sets out different meanings of an economic constitution, and applies them to key areas of economic management, including taxation and public borrowing, the management of public spending, (including the Spending Review), monetary policy, financial services regulation, industrial policy (including state shareholdings) and government contracting. It analyses the key institutions involved such as the Treasury and the Bank of England, also including a number of less well-known bodies such as the Office for Budget Responsibility. There is also coverage of the international context in which these institutions operate especially the European Union and the World Trade Organisation. It thus provides an account of the public law applying to economic management in the UK. This book also adopts a critical approach, assessing the degree to which there is coherence in the arrangements for economic management, the degree to which economic policy-making is constrained by constitutional norms, and the degree to which economic management is subject to deliberation and accountability through Parliament, the courts and other institutions.

Download or read book Law Commission Fiduciary Duties of Investment Intermediaries A Consultation Paper Consultation Paper No 215 written by Great Britain: Law Commission and published by The Stationery Office. This book was released on 2013-10-28 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: The consultation paper Fiduciary Duties of Investments Intermediaries: A Consultation Paper follows on from the Kay Report on UK Equity Markets and Long Term Decision Making (see below), and uses pensions as the example, tracing a chain of intermediaries from the prospective pensioner/saver to the registered shareholder of a UK company. There are well established duties on pension trustees to act in the best interests of scheme members, and it looks at how far these duties require trustees to maximize financial return over a short time scale, and how far trustees can consider other factors such as environmental and social impact. The consultation asks: Whether the law is right to allow trustees to consider ethical issues only in limited circumstances? Whether the legal obligations on trustees are conducive to investment strategies in the best interests of the ultimate beneficiaries? and if not, what specifically ne

Book A Government that Worked Better and Cost Less Evaluating Three Decades of Reform and Change in UK Central Government

Download or read book A Government that Worked Better and Cost Less Evaluating Three Decades of Reform and Change in UK Central Government written by Christopher Hood and published by OUP Oxford. This book was released on 2015-04-02 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: The UK is said to have been one of the most prolific reformers of its public administration. Successive reforms have been accompanied by claims that the changes would make the world a better place by transforming the way government worked. Despite much discussion and debate over government makeovers and reforms, however, there has been remarkably little systematic evaluation of what happened to cost and performance in UK government during the last thirty years. A Government that Worked Better and Cost Less? aims to address that gap, offering a unique evaluation of UK government modernization programmes from 1980 to the present day. The book provides a distinctive framework for evaluating long-term performance in government, bringing together the working better and costing less dimensions, and presents detailed primary evidence within that framework. This book explores the implications of their findings for widely held ideas about public management, the questions they present, and their policy implications for a period in which pressures to make government work better and cost less are unlikely to go away.

Book Children Behind Bars

Download or read book Children Behind Bars written by Carolyne Willow and published by Policy Press. This book was released on 2015-02-11 with total page 377 pages. Available in PDF, EPUB and Kindle. Book excerpt: Every day children exiled to prison are exposed to abusive and neglectful treatment, yet their plight is hidden. Based on wide-ranging research and first-person interviews, this passionately argued book presents the shocking truth about the lives and deaths of children in custody. Drawing on human rights legislation and progress in the care and treatment of vulnerable children elsewhere, it outlines the harsh realities of penal child custody including hunger, denial of fresh air, cramped and dirty cells, strip-searching, segregation, the authorised infliction of severe pain, uncivilised conditions for suicidal children and ever-present violence and intimidation. The issues are explored through the lens of protection, not punishment, and the author finds there can be only one conclusion: child prisons must close. Providing a compelling manifesto for urgent and radical change, this book should be read by everyone who cares about child protection and human rights.

Book The Ethics and Conduct of Lawyers in England and Wales

Download or read book The Ethics and Conduct of Lawyers in England and Wales written by Andrew Boon and published by Bloomsbury Publishing. This book was released on 2023-11-30 with total page 532 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fourth edition of this respected textbook examines the regulation and conduct of lawyers in England and Wales and addresses new developments in the field, including those in international practice, sexual misconduct, and the environment. Focusing on the practice of, and interrelationship between, solicitors and barristers, the book provides background to current arrangements while exploring contemporary rules of conduct, systems of regulation, and controversies. The four main parts cover client duties, wider obligations, key contexts, and regulation. Parts one to three provide an academic introduction to the subject of lawyers' ethics. They are suitable as a core text for a semester course at undergraduate level, providing grounding for vocational training, such as the Solicitors' Qualifying Examination. Comparisons are made with conduct rules applying in other leading common law jurisdictions where relevant. These parts also explore links between the subject of ethics and the development of lawyers' practical skills. Part four applies the general principles to three elements of regulation: practice, admission, and discipline. The approach throughout is socio-legal. While the essential law is described, relevant social science research informs consideration of issues and debates.
