Excerpt: ... administering the laws by means of tribunals not altogether foreign to their habits and feelings." 2 If, as claimed, the Americans already outnumbered the Spanish (in Pensacola), it would not have been contrary to justice to give them no small share of the offices, provided they were bona fide residents, especially as the government was ultimately to be assimilated to the American system. Yet Governor Jackson says that, in making up his civil list, he was desirous to give preference, where possible, to the old inhabitants. However, he found but few willing to accept any situation, owing to their unwillingness to lose their rights' as Spanish subjects. The governor attributed this to the fact that the greater part had been connected with the government in some way, or that they had private claims which might be prejudiced by any act evincing their intention to become American citizens.' The first reason seems incredible, in view of the fact that he found it necessary to have a special commissioner search for the government! Attention has not been called to these irregularities because they prove that the general was guilty of high crimes and misdemeanors. There was, indeed, no legal excuse for them, for he was bound, both by his commission and the law of nations, to preserve the existing municipal regulations. He was not the new sovereignty authorized to change them, nor could he do it under his commission as captain-general, that office having been stripped of legislative powers. But the changes were bound to come, and then probably was the best time to begin. The chief lesson, then, lies in the warning against making promises the meaning of which is not known, and against sending out governors to strange situations...

Book excerpt: Excerpt from The Office of Justice of the Peace in England in Its Origin and Development The following pages constitute the partial result of a study which I began under the direction of Professor F. York Powell at Oxford University in 1898. My original purpose was to make a somewhat detailed research into English local government during the sixteenth and seventeenth centuries, and I devoted some time to an investigation of the county histories and records. As the work progressed, I became conscious of the need of a better historical foundation, and turned my attention to a study of the justice of the peace. The undertaking way shortly afterward laid aside for three years until, as Fellow of Columbia University, I was able to continue my study, although without the aid of many sources which are available only in England. However, the limitation of the subject to the period ending with the accession of James I. has enabled me to make the work in a measure complete; for the county records now in existence, so far as I have been able to discover by personal research and correspondence, do not extend beyond the reign of Elizabeth, and the documents of that time are few and fragmentary. The chief sources like the Statutes of the Realm, Calendars of the Rolls, and Rotuli Parliament torum have been at my disposal and I have endeavored to make use of all the important material they contain. The method of treatment is to be explained by the fact that I have sought to trace the historical evolution of the office as well as to describe its constitution and competency. Book excerpt: Volume II of The Official History of Criminal Justice in England and Wales traces, for the first time, the genesis and early evolution of two principal institutions in the criminal justice system, the Crown Court and the Crown Prosecution Service. This volume examines the origins and shaping of two critical institutions: the Crown Court, which rose from the ashes of the Courts of Assize and Quarter Sessions; and the Crown Prosecution Service which replaced a rather haphazard system of police prosecuting solicitors. The 1971 Courts Act and the 1985 Prosecution of Offences Act were to reconfigure the architecture of criminal justice, transforming the procedures by which people were charged, prosecuted and, in the weightier cases demanding a judge and jury, tried in the criminal courts of England and Wales. One stemmed from a crisis in a medieval system of travelling justices that tried people in the wrong places and for inadequate lengths of time. The other was precipitated by a scandal in which three men were wrongly convicted for the murder of a bisexual prostitute. Theirs is an as yet untold history that can be explored in depth because it is recent enough, in the words of Harold Wilson, to have been ‘written while the official records could still be supplemented by reference to the personal recollections of the public men who were involved’. This book will be of much interest to students of criminology and British history, politics and law.
