Book excerpt: Excerpt from The North American Review, Vol. 149 While, then, it should be distinctly understood as not open to debate that the faculty must govern the college, and must absolute ly decide in any issue between them and the students, still the con stant aim and unceasing study should be to make it unnecessary for them to use their authority by cultivating in all ways among the students the manly and earnest spirit which makes the resort to authority unnecessary, and especially by leading the students to feel that their teachers are not spies and antagonists, but their true friends, eager to assist them in every way. A great improve ment has taken place in this generation in the relations of college officers and students, and in the general demeanor of students. That improvement has been largely due to the adoption to a greater or less extent of the principles advocated in this paper. In most colleges the petty and detailed supervision of the student's daily and hourly life has been relaxed or abandoned. Less reliance for insuring good conduct is now placed on manifold restraints than on the appeal to a manly spirit in the student. I am of the opinion that the introduction of the elective system in the latter part of the college course has also been most beneficial from a moral, as well as from an intel lectual, point of view. The compulsory pursuit of unwelcome studies in the junior and senior years used to cause much friction and discontent. It is, in some respects, the most difficult, requiring, and certainly, far the most laborious study. The facts for civil history we gather from personal experience, or from the examination of a comparatively few authors, whose statements the historian transfers, with such modification and commentary as he pleases, to his own pages. But in literary history, the books are the facts, and pretty substantial ones in many cases, which are not to be mastered at a glance, or on the report of another. It is a tedious process to read through a library in order to decide that the greater part is probably not worth reading at all. Literary history must come late in the intellectual development of a nation. It is the history of books, and there can be no history of books till books are written. It presupposes, moreover, a critical knowledge, - an acquaintance with the principles of taste, which can come only from a wide study and comparison of models. Nearly all the nations of Europe have furnished their quota for making up the population of the United States, so that if each stock had preserved its original characteristics, the aggregate of the inhabitants of this country would have resembled the conglomerate or pudding-stone formation in geology, in which angular and rounded pebbles, with every variety of size, shape, and internal composition, are merely held together by a rocky cement, - united by juxtaposition, but by no chemical affinities. A monarchical government, which has extended its dominions by conquest, and holds the greater portion of them merely by the sword, causes only this imperfect and unnatural union among the several classes of its subjects; - the mortar which binds them may be more or less indurated, according to its degree of native strength, or to the lapse of time during which it has been exposed to the action of elemental forces; but the pebbles imbedded in it continue unchanged; their form remains as it was determined by mutual attrition, when they were free to roll over each other under the impulse of the waves and the resistance of the beach. But perhaps, in surveying him as a poet, some additional reasons may be given in proof that he was original in the sense in which the word is applied to the recognized masters of song. In estimating the relative worth and rank of a poet, we are hound to consider not merely his possession of "the vision and the faculty divine," but the penetration and extent of his vision and the originality of his faculty. Did his spiritual insight go deeper than that of other poets of his age and generation? Did he advance beyond the recognized frontier of the ideal world in his time, and add a new province to it? Were his verses imitations or revelations? Did his poetic faculty work on old materials, adding only an individual flavor to new combinations of the old, or did he create or spiritually discern new materials for poetic treatment? In the case of Emerson, these questions can be answered only by a survey of what had been done by the great poets of the century, when (to use General Sheridan's significant phrase) he "took the affair in hand." Outside of slavery, even in almost every depth of barbarism, circumstances serve to increase human power. But in slavery, not only are natural rights denied, but, what is quite as injurious, necessary wants are supplied; everything contributes to the repression of faculty. The slaveholder's institution is a nursery for perpetuating infancy; and the more enlightened the nurse, the more successful his efforts. The world has waited for the nineteenth century and republican institutions to develop slavery in its hugest and most direful proportions; and now that the man-owner's reckless pride has made its fatal mistake, the most shameful spectacle that ever saddened earth is opened for the nations to behold, - the spectacle of a race of stunted, misshapen children, writhing from the grasp of that people which, in so many respects, is the foremost of the age. It is this immaturity that occasions the chief difficulty in analyzing the negro's nature, as we see it in the South. In each separate faculty of his mental and moral constitution we miss the effect of training. No tendency has had scope to display its direction and vigor. Book excerpt: Excerpt from The North American Review, Vol. 8 Sir William Jones, in a letter to Lord Althorpe, written after one of those excursions to France, in which his inquisitive mind, grasping every species of intellectual attainment, combined the severer studies of political science and law with the luxury of oriental literature, states that he had, among his various pursuits, attended some causes at the Palais, and brought home with him the works of a most learned lawyer, whose name and merit he should have the honour of making known to his countrymen. This writer was Pothier, whom he afterwards noticed and imitated in his beautiful essay on the Law of Bailments, and of whose treatises on the different species of contracts he speaks in the following enthusiastic manner: 'I seize with pleasure an opportunity of recommending those treatises to the English lawyer, exhorting him to read them again and again; for if his great master, Littleton, has given him, as it must be presumed, a taste for luminous method, apposite examples, and a clear manly style, in which nothing is redundant, nothing deficient, he will surely be delighted with works in which all those advantages are combined, and the greatest portion of which is law at Westminster as well as at Orleans.
