This writer was Pothier, whom he afterwards noticed and imitated in his beautiful essay on the Law of Bailments, and of whose treatises on the different species of contracts he speaks in the following enthusiastic manner: 'I seize with pleasure an opportunity of recommending those treatises to the English lawyer, exhorting him to read them again and again; for if his great master, Littleton, has given him, as it must be presumed, a taste for luminous method, apposite examples, and a clear manly style, in which nothing is redundant, nothing deficient, he will surely be delighted with works in which all those advantages are combined, and the greatest portion of which is law at Westminster as well as at Orleans. Book excerpt: Excerpt from The North American Review, Vol. 134 The human mind, connected as it is with matter, so far as we know anything about it, in its best estate is an unknown quantity, having no unit or standard of measurement by which it can be accurately denned. Hence it is often most difficult, or even impossible, to determine precisely when there is a departure from the healthy standard or normal condition. No two individuals being alike in their normal condition of mind, it follows that each must be his own standard for comparison, and that an uncertain one. No words in the language have yet been able to define mind, sane or insane; and it has no synonym but mystery. Over the portal that leads to the luminous temple where thought dwells, the pilgrim who would enter there sees written in letters of living light the inscription: "Put off thy shoes from off thy feet, for the ground whereon thou standest is holy ground." It is the temple of an unknown God, and whosoever would rush unbidden into this presence, thinking to sit face to face with and to understand its mysteries, is but little less than a madman himself. Whether the subject be sanity or insanity, it will be found firmly and securely intrenched behind ramparts, and surrounded by insurmountable difficulties - a terra incognita. Yet, with all the difficulties surrounding the case, there is not, perhaps, a more important question upon which human tribunals have to pass - aided by such help as human testimony can afford - than that of the responsibility or the irresponsibility of the alleged insane, affecting, as it does, the rights of property, of person, and of society at large. That no confusion of ideas may arise, no misapprehension of the points at issue, and that the field of discussion may be properly circumscribed and defined, and no words or time wasted, let it be said at the outset, and distinctly understood, that there can be no dispute as to the entire irresponsibility of that class of insane criminals coming within the famous rule of the English judges: those not knowing the difference between right and wrong. A person utterly unconscious of the distinction between good and evil, justice and injustice, right and wrong, at the time of committing the offense, by the common consent and judgment of mankind, is not responsible for his act. Book excerpt: Excerpt from The North American Review, Vol. 138 United States - an instrument for which, be it said, we have the most profound reverence, believing, as we do, that those who framed it were inspired of the Almighty. This unconstitutional exaction, which "at one fell swoop" for the time being disfranchised a whole Territory, amounted to this, that a man must swear that he had never simultaneously lived with more than one woman "in the marriage relation." Those who cohabited with more than one woman in adultery or prostitution were not affected by its provisions. The roue, the libertine, the strumpet, the brothel-keeper, the adulterer and adulteress could all vote; no matter how licentious a man or woman might be, all were screened and protected by this law. It was not enacted, as has been supposed, to punish licentiousness and debauchery, but was aimed expressly against those who were associated with more than one woman "in the marriage relation." All, indeed, had their franchise protected except the man who had now, or ever had had, more than one wife, or the woman who had ever been the wife of a polygamist, be she the first, second, or other wife. For the commissioners were such broad constructionists that they declared that no man or woman who ever had been a member of a family practicing plural marriage should be permitted to vote. This action was ex post facto in the extreme. It punished men and women without trial, by robbing them of the franchise for doing acts which, at the time when they were done, were not unlawful. It was, at the same time, a bill of attainder. The first antipolygamy law of Congress was passed in 1862, and all those who had, previous to that time, from deep religious conviction, received and entered into that order of marriage, but had never broken a law of the United States by so doing, for the simple reason that there was no such law, were, by the commissioners' rulings, equally debarred from voting with those who had married in plurality subsequent to that date. We claim that this ruling is eminently unjust, altogether unprecedented, and in violation of the Constitution. But at the same time, in justice to the commissioners, it must not be forgotten that they had a very difficult and delicate task to perform, so much was expected by the country from them, as the executors of the Edmunds law, the passage of which had been procured by the influence of religious fanatics and political demagogues.
