Book excerpt: This book examines how the EU and international law frameworks impact the EU’s ability to act normatively in its external action in the area of fisheries. The EU, a major fishing power, portrays itself as a normative actor and a champion of sustainable fishing. The volume reconceptualises the Normative Power Europe narrative by identifying three interrelated elements – universality, use of instruments, and legitimacy – as the key criteria against which to evaluate the normativity of the EU’s conduct. The universality element examines the level of international acceptance of the stated aims of EU action; the use of instruments element examines the EU’s participation limitations in relevant international institutions and the means (persuasion as opposed to coercion) through which it acts; and the legitimacy element examines the substance of the EU’s action in terms of legality, protection of common or self-interests, and coherence and consistency. The book draws upon extensive research into both the international and EU legal frameworks relating to fisheries and the EU’s practice in its external fisheries relations. It consecutively discusses four sets of challenges: (i) to the EU’s normativity posed by lack of membership in global institutions; (ii) created notwithstanding membership in other global or regional bodies; (iii) connected to multileveled coercive action and (iv) to accessing foreign fishing resources. It claims that, while the EU’s normativity depends greatly on its internal and external powers, it is the EU’s inability to freely wield these powers that damages its normativity. To act normatively, the EU primarily needs the full Member States’ support, as its present constitution prevents it from acting completely independently from them. The volume is aimed at academics and practitioners alike working in the area of fisheries globally but also on the EU’s external action more generally. This volume probes differences in willingness to adopt or adapt norms between various actors in the recipient state and explores such questions as: How do norm-takers perceive of the EU and its norms? Is there a ‘normative fit’ between EU norms and the local normative context? Similarly, how do EU norms impact recipients’ interests and institutional arrangements? It claims that the type of power constituting a transnational regime transcends traditional forms of constitutional legality. It argues that the European constitutional project is out of step with the normative make-up of such a regime. It is to be feared, indeed, that the adoption of a Constitution for Europe would create a smokescreen obscuring a new and disturbing reality. Drawing on the ancient tradition of linking different types of political power with the composition of the citizen's soul, the book explains that a transnational regime is based on an understanding of citizenship that is different from that underlying a constitutional democracy. Citizens are deemed to be essentially separate from one another. They abandon the larger society to itself and pursue their good in the private sphere. In place of trust and reliance in their own power to bring about change through common action, they hope to benefit from entrusting "problem-solving" to international networks of expertise. Essentially, citizens of this kind exhibit a strong commitment to individualism. The book shows how individualism is reflected in the regulatory authority that the Union claims for itself, in particular as regards the regulation of the internal market.

Book excerpt: By shedding light on EULEX - the EU mission to Kosovo – this open access book investigates the EU’s peacebuilding activities in that country, in the light of the normative power theory in the post-conflict setting and peacebuilding theory. Ten years after the massive engagement of the EU in the country torn by war, the authors critically assess the effects of the EU projecting its normative power – the enforcement of its standards, ‘good’ or ‘bad’ – through the EULEX mission, taking into consideration also the local aspects, so far neglected in this field of research. Inspecting thoroughly the EULEX activities in the police, customs and judiciary sector, the authors reveal that the mission can contribute to a positive change, but only in those cases which do not request a heavy political involvement and broad leverage by other international players (for example in improving standards of work in police and customs). When it comes to the most serious cases of organized crime, corruption and war crimes, EULEX, however, has not been able to address them effectively due to several internal mission’s deficiencies and external factors; the perceived ineffectiveness of EULEX among the local population led to the lowering of trust not only in this CSDP mission, but also in the EU in general. This open access book offers a comprehensive assessment of the EULEX mission, based on two Horizon2020 research projects: IECEU - Improving the Effectiveness of Capabilities in EU Conflict Prevention, and KOSNORTH – The European Union and its Normative Power in a Post-conflict Society: A Case Study of Northern Kosovo (Marie Sklodowska-Curie Individual Fellowship). The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy.
