Excerpt: ...magistrate to give it to him, and we think it would rarely be withheld when it was proper to grant it, and of course his counsel might be consulted. By the 23d rule of court the answers in depositions to be used both in courts of law and equity, are to be written by the magistrate without the interference of either party, and it is reasonable to suppose that in changing the law so as to require the deposition. of the trustee to be taken, a conformity with this rule was contemplated. If not it is difficult to perceive the reason of so marked a change in the terms. Upon these views we think that under the General Statutes the answers of the trustee should be written by the magistrate, as in the case of other depositions. The remaining question is whether the new law applies to actions periding at the time it took effect, this action having been entered April Term, 1867, and the law going into operation January 1, 1868. Upon examining the new law relating to the trustee process and the not repealing the Revised Statutes, which is chap. 273, we find nothing to indicate a purpose to apply the new enactments to actions pending. On the contrary the provision for taking the trustee's deposition beforethe return day of the writ cannot apply to actions already entered in court; and the repeal is made subject to the provisions of the chapter of which it makes part, chapter 273, one of which, section 5, is that the repeal shall not affect any trial or proceeding had or commenced before the time when said repeal shall take effect; but the proceedings in every such ease shall be conformed, when necessary, to the provisions of the General Statutes. Excerpt: ...the cart-path a number of years ago, and used it somewhat subsequently in hauling logs, and, on re-direct examination, that he knew of no right that Taylor had to go through there. There was no other evidence tending to show that Taylor or any other person had any ri ht in the cart-path. It was not claimed that the evidence tended to show a prescriptive right. The defendants claimed that the Ed erlys received a special benefit from the highway, because it too the place of the cart-path and relieved their land from any right that Taylor had to pass over it. In the course of the instructions to the jury the presiding justice stated that he did not recall any evidence showing that any one had a right to pass in the cart-path over the Edgerly land except the owners; to which the defendants excepted. The defendants asked the court to instruct the jury that if they found that the opening of the new road through the Edgerly land increased the value of the wood and timber on their land, this was a matter of special benefit to them to be considered in assessing damages. The court declined to give the instruction, and they excepted. They also asked the court to instruct the jury that in fixing the amount of damages they could not agree each one should mark the amount he estimated to be the damages, and that the total of such amounts should be added together and their sum divided by twelve, and that the quotient should be the amount of the verdict. Excerpt: ...is without meaning, and superfluous, unless police courts may exist after towns vote to abolish the salaries of the justices. A general police-court law was passed in 1852, under which a police court was established in each town that adopted the provisions of the act and voted to pay the justice not less than $100 annually in full compensation for his services. Laws 1852, c. 1282, ss. 1, 7, 12. There was no provision authorizing a rescission of a vote adopting the act, or a refusal to pay a salary to the justice. By an amendment of this act, in 1854, any town was empowered " to rescind any vote by which said provisions shall have been so adopted;" and it was further enacted, that "all right to hold oflice by virtue of said act or any of its provisions, or to perform the duties thereof, shall cease and be fully determined upon the rescission of any vote for its adoption as aforesaid. And no such town shall be deemed liable for any salary or other compensation for services rendered thereafterwards by any oflicer therein named, and performed under the provisions of said act." Laws 1854, 0. 153-1, ss. 1, 2. This amendment allowed the town to abolish its police court by a rescinding vote; but until rescission, it remained liable for the salary. The present provision, allowing the town to rescind the salary and giving the justice the fees when his salary is rescinded (G. L., c. 215, s. 16), is a copy of Gen. St., c. 196, s. 14, which was proposed by the commissioners of revision in 1867 as a substitute for former law, and was marked by them as materially different. The difference between the amendment of 1854 and the substitute of 1867 is too great to admit a supposition that the legislature understood that one...
