Donald Bloxham here examines the actions and trials of German soldiers and policemen, the use of legal evidence, the refractory functions of the courtroom, and Allied political and cultural preconceptions of both 'Germanism' and of German criminality. Book excerpt: At the end of World War II, Allied armies recovered a large portion of the written or filmed evidence of the Holocaust and other forms of Nazi persecution. Allied prosecutors used newly found records in numerous war crimes trials. Governments released many related documents regarding war criminals during the second half of the 20th century. A small segment of American-held documents from Nazi Germany or about Nazi officials and Nazi collaborators, however, remained classified into the 21st century because of government restrictions on the release of intelligence-related records. Approximately 8 million pages of documents declassified in the United States under the 1998 Nazi War Crimes Disclosure Act added significantly to our knowledge of wartime Nazi crimes and the postwar fate of suspected war criminals. A 2004 U.S. Government report by a team of independent historians working with the government's Nazi War Criminal Records Interagency Working Group (IWG), entitled U.S. Intelligence and the Nazis, highlighted some of the new information; it appeared with revisions as a 2005 book.1 Our 2010 report serves as an addendum to U.S. Intelligence and the Nazis; it draws upon additional documents declassified since then. The latest CIA and Army files have: evidence of war crimes and about the wartime activities of war criminals; postwar documents on the search for or prosecution of war criminals; documents about the escape of war criminals; documents about the Allied protection or use of Nazi war criminals; and documents about the postwar political activities of war criminals. None of the declassified documents conveys a complete story in itself; to make sense of this evidence, we have also drawn on older documents and published works.

Book excerpt: Human Rights after Hitler is a groundbreaking history about the forgotten work of the UN War Crimes Commission (UNWCC), which operated during and after World War II in response to Axis atrocities. He explains the commission's work, why its files were kept secret, and demonstrates how the lost precedents of the commission's indictments should introduce important new paradigms for prosecuting war crimes today. The UNWCC examined roughly 36,000 cases in Europe and Asia. Thousands of trials were carried out at the country-level, and hundreds of war criminals were convicted. This rewrites the history of human rights in the wake of World War II, which is too focused on the few trials at Nuremberg and Tokyo. Until a protracted lobbying effort by Plesch and colleagues, the UNWCC's files had been kept out of public view in the UN archives under pressure from the US government. The US initially wanted the files closed to smooth the way for post-war collaboration with Germany and Japan, and the few researchers who did gain permission to see the files were not permitted to even take notes until the files' recent release. Now revealed, the precedents set by these cases should have enormous practical utility for prosecuting war crimes today.

Part of the answer lies in the nature of the major wars fought in the 20th century and in the changing nature of warfare itself. This study looks at war crimes committed during the Second World War in the USSR, Yugoslavia, Germany, and efforts to bring the perpetrators to justice. This led to successful postwar efforts to define and outlaw such crimes and, more recently, the creation of two international courts to bring war criminals to justice. This did not prevent the commitment of war crimes and acts of genocide throughout the world, particularly in Asia and Africa. And while efforts to bring war criminals to justice has been enhanced by the work of these courts, the problems associated with civil wars, command responsibility, and other issues have created new challenges for the international legal community in terms of the successful adjudication of such crimes. This book was based on a special issue of Nationalities Papers.
