Book excerpt: Increased global demand for land posits the need for well-designed country-level land policies to protect long-held rights, facilitate land access and address any constraints that land policy may pose for broader growth. While the implementation of land reforms can be a lengthy process, the need to swiftly identify key land policy challenges and devise responses that allow the monitoring of progress, in a way that minimizes conflicts and supports broader development goals, is clear. The Land Governance Assessment Framework (LGAF) makes a substantive contribution to the land sector by providing a quick and innovative tool to monitor land governance at the country level. The LGAF offers a comprehensive diagnostic tool that covers five main areas for policy intervention: Legal and institutional framework; Land use planning, management and taxation; Management of public land; Public provision of land information; and Dispute resolution and conflict management. The LGAF assesses these areas through a set of detailed indicators that are rated on a scale of pre-coded statements (from lack of good governance to good practice). While land governance can be highly technical in nature and tends to be addressed in a partial and sporadic manner, the LGAF posits a tool for a comprehensive assessment, taking into account the broad range of issues that land governance encompasses, while enabling those unfamiliar with land to grasp its full complexity. The LGAF will make it possible for policymakers to make sense of the technical levels of the land sector, benchmark governance, identify areas that require further attention and monitor progress. It is intended to assist countries in prioritizing reforms in the land sector by providing a holistic diagnostic review that can inform policy dialogue in a clear and targeted manner. In addition to presenting the LGAF tool, this book includes detailed case studies on its implementation in five selected countries: Peru, the Kyrgyz Republic, Ethiopia, Indonesia and Tanzania.

The post-colonial African states have had to embark on concerted efforts at redressing historical grounded land policies and addressing the growing needs of land by the poor. However, agitations for land continue, while evidence of policy gaps abound. In many cases, policy change in terms of land use, distribution and ownership has reinforced inequalities and affected power and social relations in respective post-colonial African countries. Land has assumed major causes of structural violence and impediments to human and rural development in Africa; hence the need for holistic assessment of land reforms in post-colonial African states. The book suggests practicable policy options towards addressing the land hunger and conflict, which could derail the ‘moderate’ socio-economic achievements and political stability recorded by post-colonial African nation-states. Food security crises in developing countries in the past decades have revived the debate about whether land tenure systems constrain farmer innovation and investment in agriculture. Changes in tenure systems can potentially have major implications for agricultural transformation. This chapter summarizes the arguments about how best to provide land tenure security in SSA and reviews recent experience and evidence arising from innovative interventions, with implications for other developing regions as well. It is hoped that the experiences and topics analyzed here may also help Venezuela in the process of normalizing land tenure systems in that country.

Book excerpt: This paper assesses the nature of land administration service delivery in Nigeria using data collected from three sets of participants in land administration processes: 76 service providers, 253 beneficiaries, and 172 professionals. The data were collected from eight states selected from the six geopolitical zones of the country—Cross River, Benue, Bauchi, Ekiti, Enugu, Kaduna, and Lagos states, plus the Federal Capital Territory (Abuja). These were chosen because they are considered to have advanced land administration systems. Our findings show that land registration processes in Nigeria take a long time: nearly 80 percent of beneficiaries and 41 percent of professionals responded that land registration took more than two years to complete after first apply-ing. This difference between beneficiaries and professionals may stem from the fact that many professionals, who gener-ally are better educated, may know more about the application process than do beneficiaries and are able to navigate the process more efficiently. Land registration information guidelines seem to be rarely available to the public. Consequently, the dominant means of access to land administration institutions is through direct contact. Coordination among govern-ance structures put in place by states for land administration also was found to be poor, especially in Bauchi and Enugu states, where very low levels of cooperation on issues related to land administration reforms were observed.

Book excerpt: This book is on the study of resource utilization and management, a case study of the impact of state land ownership and land use regulation on development in Nigeria from 1955-1985. In 1978, the Federal Military Government of Nigeria promulgated a Land Use Decree whose objectives were to introduce a uniform land policy for the whole country, control hoarding and speculating in land, and facilitate the allocation of land for national development. However, critics of the decree argued that the new land policy amounted to nationalization of land in the country, and wondered whether such development strategy was appropriate in the 21st century In light of the foregoing this author examined the impact of the new land policy on development in Nigeria from 1955-1985, using qualitative and quantitative methods. The beginning and end of the study period coincide with the end of the colonial development plans that started in 1946 and ushered in Nigerias independence in 1960, and the end of the fourth national development plan of 1981-1985 under the military government that overthrew the civilian government in 1966, The study in this book is significant because of the importance of land as one of the most important factors of production in any society, others being labor, capital, entrepreneurship, and information resources. The implementation problems associated with the new land use law are highlighted. This author believes, however, that it is necessary that further research should be undertaken continually in the future, especially with a view to examining the effectiveness of the implementation experiences since the promulgation of the land use law in 1978.
