Max Baucus, U.S. Senator From The State Of Montana Senator Baucus. Any discussion of the National Environmental Policy Act, otherwise known as NEPA, goes to the heart of this committees purpose. In the past, in 1969, NEPA marked the beginning of the modern environmental era. The National Environmental Policy Act is short and sweeping in its breadth, and its stated purpose is to "encourage productive and enjoyable harmony between man and his environment." In language that anticipates the present discussions of sustainable development, NEPA proposes to "create and maintain conditions under which man and nature can exist in productive harmony and fulfill the social, economic, and other requirements of present and future generations of Americans." But this is 1993, and our understanding of the environment has grown. The immediate stimulus for this hearing Judge Charles Ritchie's thought-provoking decision of several weeks ago. He held that NEPA requires the administration to complete an environment impact statement, or an EIS, on the North American Free Trade Agreement before submitting it to Congress. The decision raises important questions about the relations between Congress and the Executive Branch. To see the environment impacts of a trade agreement you need only go to the U.S./Mexican border. In the 1960's, the United States and Mexico negotiated an agreement granting U.S. companies tariff concessions if they assembled products in Mexican border plants for reexport to the United States.
