Available in PDF, EPUB and Kindle. Book excerpt: Referred to as the "bible of American lawyers," Blackstone's Commentaries on the Laws of England shaped the principles of law in both England and America when its first volume appeared in 1765. For the next century that law remained what Blackstone made of it. Daniel J. Boorstin examines why Commentaries became the most essential knowledge that any lawyer needed to acquire. Set against the intellectual values of the eighteenth century-and the notions of Reason, Nature, and the Sublime—Commentaries is at last fitted into its social setting. Boorstin has provided a concise intellectual history of the time, illustrating all the elegance, social values, and internal contradictions of the Age of Reason.

Book The Transatlantic Gothic Novel and the Law 1790 1860

Download or read book The Transatlantic Gothic Novel and the Law 1790 1860 written by Bridget M. Marshall and published by Routledge. This book was released on 2016-02-17 with total page 199 pages. Available in PDF, EPUB and Kindle. Book excerpt: Tracing the use of legal themes in the gothic novel, Bridget M. Marshall shows these devices reflect an outpouring of anxiety about the nature of justice. On both sides of the Atlantic, novelists like William Godwin, Mary Shelley, Charles Brockden Brown, and Hannah Crafts question the foundations of the Anglo-American justice system through their portrayals of criminal and judicial procedures and their use of found documents and legal forms as key plot devices. As gothic villains, from Walpole's Manfred to Godwin's Tyrrell to Stoker's Dracula, manipulate the law and legal system to expand their power, readers are confronted with a legal system that is not merely ineffective at stopping villains but actually enables them to inflict ever greater harm on their victims. By invoking actual laws like the Black Act in England or the Fugitive Slave Act in America, gothic novels connect the fantastic horrors that constitute their primary appeal with much more shocking examples of terror and injustice. Finally, the gothic novel's preoccupation with injustice is just one element of many that connects the genre to slave narratives and to the horrors of American slavery.

Book excerpt: Originally published in 1963. Perhaps the most generative ethical question of eighteenth-century France was how to live a virtuous and happy life at the same time. During the Age of Enlightenment, Christianity fell out of vogue as the dominant and authoritative moral code. In place of Christianity's emphasis on sin and redemption in light of a supposed afterlife, present happiness became recognized as an appropriate end goal among French Enlightenment thinkers. French intellectuals struggled to find equilibrium between nature (a person's individual goals and needs) and culture (the political, economic, and social organization of humans for a collective good). Enlightenment discourse generated a unique cultural moment in which thinkers addressed the problems of humans' moral coexistence through the dichotomy of nature and culture. Lester Crocker addresses these questions in an overview of ethical thought in eighteenth-century France.
