Within these pages we only hope to focus the vision of thinking men to a Bates enlightened by wise teachers, vigorous in its play spirit, severe in its mental discipline, yet patient and encouraging to its failures. Ive hope, perhaps, to suggest an alternative to any drastic change in curriculum that mav result in an effort to meet the occasional decrease in seasonal enrollment. In the very simple arrangement of this book we express our faith that Bates can represent, if it will, the interests of a lower-middle class group in creative scholarship, original thinking, and constructive service in the world of men. Let us remember both our virtues and our faults. Fortunate are we in a campus cleared by clean winds and lying close to hills and meadowlands and coun try-roads where men may walk with silence and their own thoughts. Fe'have challenged our professors to define an ideally educated man; our returns have been surprising both in numbers and in singleness of high purpose. It was not without wisdom that a Garnet writer could suggest: Bates may well raise its C standards, eliminate the unfit ruth lessly, and encourage the young man and woman who is so radical as to believe that a college should organize itself around the studies. Using principles from the anthropological theory of legal evolution, the book locates the works in their legal contexts and traces through them the gradual dissociation over the centuries of law and morality. It thereby associates and illuminates these masterpieces from an original point of view and contributes a new dimension to the study of literature and law. In contrast to prevailing adherents of Law-and-Literature, this book professes Literature-and-Law, in which the emphasis is historical rather than theoretical, substantive rather than rhetorical, and literary rather than legal. Instead of adducing the literary work to illustrate debates about modern law, this book consults the history of law as an essential aid to the understanding of the literary text and its conflicts.
