Book A Pluralist Theory of Constitutional Justice

Download or read book A Pluralist Theory of Constitutional Justice written by Michel Rosenfeld and published by Oxford University Press. This book was released on 2022-10-17 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years, liberal constitutionalism has come under sharp attack. Globalization has caused huge disparities in wealth, identity-based alienation triggered by mass migration, and accompanying erosions of democracy. Liberal populists have also adapted the framework of liberal institutionalism, masking their aim to subvert its core values. These developments bring the links between justice and the constitution to the fore, particularly concerning distributive justice in its three dimensions of redistribution, recognition, and representation. A Pluralist Theory of Constitutional Justice provides a systematic account of the central role of distributive justice in the normative legitimation of liberal constitutions. The requirements of distributive justice are highly contested, and constitutions are susceptible to influencing those they govern. By drawing on Rawls' insight that distributive justice calls for "constitutional essentials", Rosenfeld advances the thesis that liberal constitutions must incorporate certain "justice essentials". This book is divided into three sections. Part one examines the current legal, economic, political and ideological developments that pose challenges to the normative viability of liberal constitutionalism. Part two offers a rereading of philosophical and jurisprudential literature that sheds crucial light on the relationship between constitution and justice. Finally, part three makes a case for using a thoroughly pluralistic approach in the quest for a constitution's justice essentials.

Download or read book Administering Interpretation written by Peter Goodrich and published by Fordham Univ Press. This book was released on 2019-05-21 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: Populism in politics and policy orientations in law have thrown the jurisdiction of the academy and the disciplines of interpretation into disarray. Critique flounders in abstraction and negativity, law loses itself in particularity. Administering Interpretation brings together philosophers, humanists, and jurists from both continental and Anglophone jurisdictions to reassess the status and trajectory of interpretative theory as applied in the art of law. Tracking the thread of philosophical influences upon the community of legal interpretation, the essays move from the translation and wake of Derrida to the work of Agamben, from deconstruction to oikononmia. Sharing roots in the philological excavation of the political theology of modern law, contributors assess the failure of secularism and the continuing theological borrowings of juridical interpretation. The book brings contemporary critique to bear upon the interpretative apparatuses of exclusion, the law of spectacular sovereignty, and the bodies that lie in its wake. Contributors: Giovanna Borradori, Marinos Diamantides, Allen Feldman, Stanley Fish, Pierre Legrand, Bernadette Meyler, Michel Rosenfeld, Bernhard Schlink, Jeanne Schroeder, Laurent de Sutter, Katrin Trüstedt, Marco Wan

Download or read book The Matrix of Mysticism written by Martin Hudale and published by Xulon Press. This book was released on 2008-10 with total page 482 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Matrix of Mysticism A Call for a New Reformation is on the cutting-edge pioneering into rarely-explored theological and religious history of Roman Catholicism. This book reveals that while under influence of humanistic and mystical teachings of the Roman Church, many Catholic priests committed vicious acts of homosexual molestation against Catholic adolescent boys and children. Using the 2002 clergy sexual-abuse scandal as a launching pad, the author exposes the cause and effect relationship between Catholicisms celibate-monastic mysticism and its long history of clerical sexual dysfunctions. The author documents how the Catholic Churchs occult Gnostic/Neoplatonic worldview regarding the antagonistic differences between the flesh and spirit became the motivating cause for its history of clerical sexual promiscuity and antifeminine mind-set as well as its rationale to deify Mary, the mother of Jesus, as an incarnation of the divine feminine. Martin Hudale spent 12 years in pre-Vatican II Catholic boarding schools and seminaries. During this time, he studied various Roman Catholic doctrines pertaining to dogmatic, moral, ecclesiastical, sacramental and patristic theology. He was required to study Aristotelian and Platonic philosophy along with logic, epistemology and the Latin and Greek classical literature. As a result, he has the background experience, knowledge and credibility to write this book. After being ordained a Catholic priest, he worked four years at an inner-city parish church in the United States where his awareness of the homosexual and immoral lifestyles among some of his fellow priests was an important factor causing him to leave the priesthood. After he became a born-again Christian at the age of 40, he spent approximately 25 years researching and writing this book while receiving an M.S.degree in Counseling Psychology. He is presently married to his wife of 35 yrs. and the father of three adult children.

Book Hospitality of the Matrix

  • Author : Irina Aristarkhova
  • Publisher : Columbia University Press
  • Release : 2012-07-31

Download or read book Hospitality of the Matrix written by Irina Aristarkhova and published by Columbia University Press. This book was released on 2012-07-31 with total page 247 pages. Available in PDF, EPUB and Kindle. Book excerpt: The question "Where do we come from?" has fascinated philosophers, scientists, and artists for generations. This book reorients the question of the matrix as a place where everything comes from (chora, womb, incubator) by recasting it in terms of acts of "matrixial/maternal hospitality" producing space and matter of and for the other. Irina Aristarkhova theorizes such hospitality with the potential to go beyond tolerance in understanding self/other relations. Building on and critically evaluating a wide range of historical and contemporary scholarship, she applies this theoretical framework to the science, technology, and art of ectogenesis (artificial womb, neonatal incubators, and other types of generation outside of the maternal body) and proves the question "Can the machine nurse?" is critical when approaching and understanding the functional capacities and failures of incubating technologies, such as artificial placenta. Aristarkhova concludes with the science and art of male pregnancy, positioning the condition as a question of the hospitable man and newly defined fatherhood and its challenge to the conception of masculinity as unable to welcome the other.

Boyd and Al Larson use the vehicle of The Matrix film trilogy to argue that our struggles with habitual sin, thought patterns, damaged emotions, and phobias happen because we do not know how to take charge of the way we experience reality. The authors draw on biblical and psychological insights to provide practical resources for helping believers escape the matrix of the world system that ensnares them.
