  • Author : William E. Wiethoff
  • Publisher : University of Georgia Press
  • Release : 2010
  • ISBN : 0820336327
  • Pages : 264 pages

Download or read book A Peculiar Humanism written by William E. Wiethoff and published by University of Georgia Press. This book was released on 2010 with total page 264 pages. Available in PDF, EPUB and Kindle. Book excerpt: In early-nineteenth-century America, and especially in the Old South, the use of oratory appealed to legal professionals--judges as well as advocates. Consistent with the humanism proclaimed in classical and neoclassical works, appellate judges perceived their civic duties to demand oratorical skill as well as legal expertise. In A Peculiar Humanism, William E. Wiethoff assesses the judicial use of oratory in reviewing slave cases and the struggle to fashion a humanist jurisprudence on slavery despite the customary restraints placed on judicial advocacy. Drawing attention to a neglected intersection of law and letters, Wiethoff analyzes the proslavery discourse embedded in antebellum judicial opinions by examining the public addresses, judicial narratives, and private papers of sixty-nine appellate judges. By contrasting the judges' proslavery appeals in a variety of cases in the upper and deep South, Wiethoff shows how context shaped the judges' perceptions, priorities, and arguments. An outstanding contribution to the literature on law and slavery, A Peculiar Humanism testifies to the character of the legal profession in the Old South and serves as an index of the beliefs and attitudes that coexisted with legal decision making.

Book The Caning of Charles Sumner

Download or read book The Caning of Charles Sumner written by Williamjames Hoffer and published by . This book was released on 2010-05-03 with total page 164 pages. Available in PDF, EPUB and Kindle. Book excerpt: Charles Sumner was seated at his Senate desk on May 22, 1856, when Democratic Congressman Preston S. Brooks approached, pulled out a walking stick, and struck him on the head. Brooks continued to beat the stunned Sumner, forcing him to the ground and repeatedly striking him even as the cane shattered. He then pursued the bloodied, staggering Republican senator up the Senate aisle until Sumner collapsed. Colleagues of the two intervened only after Brooks appeared intent on beating the unconscious Sumner, perhaps, to death. The caning on the Senate floor embodied just how wide the complex North-South cultural divide of the mid-nineteenth had become, and explains why the coming war was so difficult to avoid.

Book The Center Could Not Hold Congressman William H English and His Antebellum Political Times

Download or read book The Center Could Not Hold Congressman William H English and His Antebellum Political Times written by Elliott Schimmel and published by Atlantic Publishing Company. This book was released on 2020-08-14 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: William Hayden English of Indiana, congressman from 1853–1861, ended his official political career one and a half months before the attack on Fort Sumter. Though his name may not be as well known as other antebellum historical figures, he actively and influentially participated in all the major political events of the great drama that culminated in the most devastating war in American history. While this book is specifically a close analysis of one antebellum politician, it also acts as a comprehensive study by which one may examine not only the perspective and struggles of a single congressman, but also the contextual political environment that surrounded America’s descent into the great tragedy of the Civil War.
