Book excerpt: Excerpt from Legal and Political Status of Women in Iowa: An Historical Account of the Rights of Women IN the preparation of this monograph the writer has attempted to present a general survey of the status of women in Iowa by pointing out the distinctions between men and women which have been established by law or sanctioned by judicial rulings. The status of women with reference to activities which are not regulated either directly or indirectly by the government is outside the scope of this monograph and is not discussed in these pages. Thus the position of women in religious and other similar organizations has not been considered since this does not concern their status as citizens. Furthermore, all laws of a general nature applying equally to men and women have received only incidental mention, although such laws are Often of vital importance to women. In this class belong the laws concerning public utilities, protection of life and property, public health, and municipal administration. Unless otherwise specified or plainly inapplicable to both sexes, Iowa statute laws governing civil rights and obligations may be assumed to apply equally to men and women. Laws concerning political matters, on the contrary, refer to male citizens only unless women are specifically included. In some cases it has seemed advisable to include a brief discussion of certain aspects of the status of women which show little or no legal discrimination against women. Thus the admission of women to the public schools, to institutions of higher education, and to the professions has been discussed, although the Iowa laws show but little difference between men and women in such matters. There are two reasons for including these subjects: first, because such privileges are largely furnished at the expense of the State; and secondly, be cause the equality which has prevailed in Iowa is by no means general throughout the United States and ought not to be taken for granted. Teaching has been included for the same reasons, and also because the teacher in State supported schools is in one sense a public official. A revised edition was issued in 1870, containing notices of the changes in the laws relating to women which had been made since 1868. Statutes passed afterwards led to the publi cation of a third edition in 1875. Since that year, so extensive and important has been the legislation affecting women that a new edition is required. Very opportunely the legislature in 1882 issued the volume of Public Statutes intended to embody all statutes in force' up to that year. I have changed my original plan so far as to add references to the Public Statutes, which may be a convenience to some readers and will embarrass none. The object of the following pages is to present an outline of the law of Massachusetts affecting women, as distinguished from men, with occasional comments. And especially to point out how unfairly the dependent has been in past ages, and is at the present time, treated by the dominant sex, the vast improvement in the condition of the former made by recent legislation, and how much is still required by simple justice for its full relief. Mr. Tucker was born at New Bedford, Massachusetts, on January 19, 1852. He received the degree of Bachelor of Arts from Brown University at Providence, Rhode Island, in 1873, and his degree of Bachelor of Laws at Boston University in 1875. Subsequently, the degree of Doctor of Philosophy was conferred upon him. He practiced law in New Bedford from 1876 to 1882 and then removed his law office to Boston where he is in practice today. From 1890 to 1892, Mr. Tucker was a member of the Legislature of the Commonwealth of Massachusetts. In 1892, he was appointed the Official Reporter of the Decisions of the Supreme Court of Massachusetts. He served in this position until the year 1900. Mr. Tucker is the author of numerous treatises and articles relating to the law. Among the important are "Testamentary Forms and Notes on Wills," and "Manual of Massachusetts Corporations." He is joint author of Gould and Tucker's "Notes on United States Statutes," and with Dr. Wilson of Harvard on "International Law." So far as regards the plan, then, I may fairly claim to hold the sex responsible for its success. Not so, however, in respect to its very imperfect execution. The plan embraced more than could be brought within the limits of this volume; and it embraced a more suggestive and even a more practical form. It was intended to do, not only what has been done, but to have, also, some reflections on proposed amendments to existing laws, and some of the practical forms of business. The former, I have been obliged to limit to brief observations, scattered throughout the treatise, and the latter to omit altogether. There is room, however, on this subject, for another volume, and should this find favor with my intelligent countrywomen, it is intended to produce another, which shall be a sort of guide for them, in the every day business of life. Raphael Sealey analyzes the rights of women in marriage, in the control of property, and in questions of inheritance. He advances the theory that the legal disabilities of Greek women occurred because they were prohibited from bearing arms. Sealey demonstrates that, with some local differences, there was a general uniformity in the legal treatment of women in the Greek cities. For Athens, the law of the family has been preserved in some detail in the scrupulous records of speeches delivered in lawsuits. These records show that Athenian women could testify, own property, and be tried for crime, but a male guardian had to administer their property and represent them at law. Gortyn allowed relatively more independence to the female than did Athens, and in Sparta, although women were allowed to have more than one husband, the laws were similar to those of Athens. Sealey's subsequent comparison of the law of these cities with Roman law throws into relief the common concepts and aims of Greek law of the family. Originally published in 1990.
