Book excerpt: Until very recently, the legal gender of a person-both at birth and later in life-in virtually all jurisdictions had to be recorded as either male or female; most laws simply did not allow any other option. However, there are many cases where this gender binary is unable to capture the reality of a person's gender identity. In 2013, Germany became the first Western jurisdiction in modern times to introduce legislation allowing a person's gender to be recorded as 'indeterminate' at birth and thus give them a legal gender status other than male or female. However, despite good intentions, this legislation has proved problematic in many ways and is subject to pertinent criticism. Several other jurisdictions are now beginning to react to challenges to the gender binary. The Legal Status of Intersex Persons provides a basis for discussions surrounding law reform in this area. Neither vision is accurate. The millions of people with an intersex condition, or DSD (disorder of sex development), are men or women whose sex chromosomes, gonads, or sex anatomy do not fit clearly into the male/female binary norm. Until recently, intersex conditions were shrouded in shame and secrecy: many adults were unaware that they had been born with an intersex condition and those who did know were advised to hide the truth. Current medical protocols and societal treatment of people with an intersex condition are based upon false stereotypes about sex, gender, sexual orientation, gender identity, and disability, which create unique challenges to framing effective legal claims and building a strong cohesive movement. In Intersexuality and the Law, Julie A. Greenberg examines the role that legal institutions can play in protecting the rights of people with an intersex condition. She also explores the relationship between the intersex movement and other social justice movements that have effectively utilized legal strategies to challenge similar discriminatory practices. Intersex people are born with sex characteristics that do not fit typical notions of male or female bodies, as a result of which they are stigmatised, marginalised and denied the recognition of their fundamental rights. Often, they are subjected to involuntary and harmful sex “normalising” surgeries at birth, which violate their bodily integrity, self-determination and informed consent, so as to comply with societal and legal norms. Moreover, binary legal frameworks prevent them from enjoying the rights to access identification documents, start a family, or be free from discrimination in all areas including employment and sports. To elaborate on intersex violations that emanate from binary laws, this book examines the situation of intersex rights in regional jurisdictions worldwide and within the European Union in particular. In the process, it identifies current legal barriers and suggests how intersex people could be accommodated under legal frameworks and achieve sex/gender equality beyond binary definitions.

Book excerpt: The need to allow for a legal change of sex/gender, in certain cases, is no longer disputed in most jurisdictions. For European countries, there is no question as to whether such a change should be allowed after the decision of the European Court of Human Rights in Goodwin v. United Kingdom (Application No. 28957/95). The question has therefore shifted to what the requirements should be for such a legal change. Many jurisdictions have legislated or developed an administrative approach to changing sex/gender, but the requirements differ significantly from jurisdiction to jurisdiction, particularly with regard to age, nationality, and marital status, as well as the medical and psychological requirements. The latter, in some jurisdictions, still include surgery and sterility as a precondition, thus potentially forcing the persons concerned to choose between the recognition of their sex/gender identity and their physical integrity. This book examines questions that are thus far under-researched, namely what the full legal consequences of a legal change of sex/gender should be - for example, with regard to the existing legal relationships, such as marriages and registered partnerships, but also concerning children and parentage. The Legal Status of Transsexual and Transgender Persons is the result of an international research project, including not only national reports from 14 European and non-European jurisdictions, but also two chapters that look at legal sex/gender changes from a Christian perspective, and one chapter from a medical-psychological perspective. The final chapter compares and contrasts the different approaches and requirements and makes recommendations for best practice and law reform.

I was raised as a girl but discovered at a young age that my body looked different. Having endured an often turbulent home life as a kid, there were many times when I felt scared and alone, especially given my attraction to girls. But unlike most people in the first world who are born intersex--meaning they have genitals, reproductive organs, hormones, and/or chromosomal patterns that do not fit standard definitions of male or female--I grew up in the body I was born with because my parents did not have my sex characteristics surgically altered at birth. It wasn't until I was twenty-six and encountered the term intersex in a San Francisco newspaper that I finally had a name for my difference. That's when I began to explore what it means to live in the space between genders--to be both and neither. I tried living as a feminine woman, an androgynous person, and even for a brief period of time as a man. Good friends would not recognize me, and gay men would hit on me. My gender fluidity was exciting, and in many ways freeing--but it could also be isolating. I had to know if there were other intersex people like me, but when I finally found an intersex community to connect with I was shocked, and then deeply upset, to learn that most of the people I met had been scarred, both physically and psychologically, by infant surgeries and hormone treatments meant to "correct" their bodies. Realizing that the invisibility of intersex people in society facilitated these practices, I made it my mission to bring an end to it--and became one of the first people to voluntarily come out as intersex at a national and then international level. Born Both is the story of my lifelong journey toward finding love and embracing my authentic identity in a world that insists on categorizing people into either/or, and of my decades-long fight for human rights and equality for intersex people everywhere.

Book excerpt: Sex is complex. Humans are simultaneously more similar in their sex development, and more diverse, than is commonly appreciated or understood. Females and males are not made of wildly different ingredients. The potential to have intersex variations-to be born with atypical sex characteristics-exists for all humans in the first few weeks of their prenatal development. 1.7% of people actually go on to be born intersex. However, most of us know little about intersex variations. This is only partly due to their occasional invisibility. Intersex people have historically faced deep social stigma-the assumption that they were simply bizarre aberrations from the human norm. Furthermore, intersex infants have been widely subjected to systematic institutional mistreatment, particularly within medical settings. Finally, some people with intersex variations have simply tried to integrate themselves unnoticed into the socially accepted categories of male and female. Drawing on stories and statistics from the first national study of intersex the book argues for a distinct 'Intersex Studies' framework to address intersex issues and identity-foregrounding people with intersex variations' own goals, perspectives and experiences. Collected in 2015 and arranged in thematic chapters, the data presented here on 272 individuals gives a penetrating account of historically and socially obscured experience. Rarely, though, do individuals consider the role of the law in facilitating or inhibiting their ability to have a child or to parent. For LGBT individuals, however, parenting is saturated with legality - including the initial decision of whether to have a child, how to have a child, whether one's relationship with their child will be recognized, and everyday acts of parenting. Through interviews with 137 LGBT parents, Amanda K. Baumle and D'Lane R. Compton examine the role of the law in the lives of LGBT parents and how individuals use the law when making decisions about family formation or parenting. Baumle and Compton explore the ways in which LGBT parents participate in the process of constructing legality through accepting, modifying, or rejecting legal meanings about their families. They conclude that legality is constructed through a complex interplay of legal context, social networks, individual characteristics, and familial desires. Ultimately, the stories of LGBT parents in this book reflect a rich and varied relationship between the law, the state, and the private family goals of individuals.
