Book Critique of the Legal Order

Download or read book Critique of the Legal Order written by Richard Quinney and published by Routledge. This book was released on 2018-02-06 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: Originally published thirty years ago, Critique of the Legal Order remains highly relevant for the twenty-first century. Here Richard Quinney provides a critical look at the legal order in capitalist society. Using a traditional Marxist perspective, he argues that the legal order is not intended to reduce crime and suffering, but to maintain class differences and a social order that mainly benefits the ruling class. Quinney challenges modern criminologists to examine their own positions. As "ancillary agents of power," criminologists provide information that governing elites use to manipulate and control those who threaten the system. Quinney's original and thorough analysis of "crime control bureaucracies" and the class basis of such bureaucracies anticipates subsequent research and theorizing about the "crime control industry," a system that aims at social control of marginalized populations, rather than elimination of the social conditions that give rise to crime. He forcefully argues that technology applied to a "war against crime," together with academic scholarship, is used to help maintain social order to benefit a ruling class. Quinney also suggests alternatives. Anticipating the work of Noam Chomsky, he suggests we must first overcome a powerful media that provides a "general framework" that serves as the "boundary of expression." Chomsky calls this the manufacture of consent by providing necessary illusions. Quinney calls for a critical philosophy that enables us to transcend the current order and seek an egalitarian socialist order based upon true democratic principles. This core study for criminologists should interest those with a critical perspective on contemporary society.

Book excerpt: One of the sharpest attorneys in Charleston, S.C., Sally Baynard isn't your typical southern belle. She's certainly not what her mother hoped she'd grow up to be, especially since she divorced her husband, Family Court Judge Joe Baynard, and his historic family with their historic wealth and historic houses. Maybe Sally was never going to be a proper society lady, but her success as a public defender and family lawyer have been enough for her. She's represented murderers, burglars, drug dealers and lately has taken on some of the thorniest divorces, all cases closed with her Sally Bright Baynard wit, charm and brains. Or have they? One case she's never successfully closed is her marriage. And when Judge Joe assigns her to one of his divorce cases by appointing her as the Lawyer for the Dog -- Sherman, a miniature schnauzer-- she's forced into close quarters with him again. Juggling the needs of the dog, the angry owners, her amorous but uncommunicative ex-husband, her aging, Alzheimer's-ridden mother, and the expectations of the court is more than Sally could have imagined. And as rascally Sherman digs his way into Sally's heart, he brings along his charming vet Tony, a man who makes Sally question her views on love and marriage.

Book Who Owns Culture

    Book Details:
  • Author : Susan Scafidi
  • Publisher : Rutgers University Press
  • Release : 2005
  • ISBN : 9780813536064
  • Pages : 228 pages

Download or read book Who Owns Culture written by Susan Scafidi and published by Rutgers University Press. This book was released on 2005 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: It is not uncommon for white suburban youths to perform rap music, for New York fashion designers to ransack the world's closets for inspiration, or for Euro-American authors to adopt the voice of a geisha or shaman. But who really owns these art forms? Is it the community in which they were originally generated, or the culture that has absorbed them? While claims of authenticity or quality may prompt some consumers to seek cultural products at their source, the communities of origin are generally unable to exclude copyists through legal action. Like other works of unincorporated group authorship, cultural products lack protection under our system of intellectual property law. But is this legal vacuum an injustice, the lifeblood of American culture, a historical oversight, a result of administrative incapacity, or all of the above? Who Owns Culture? offers the first comprehensive analysis of cultural authorship and appropriation within American law. From indigenous art to Linux, Susan Scafidi takes the reader on a tour of the no-man's-land between law and culture, pausing to ask: What prompts us to offer legal protection to works of literature, but not folklore? What does it mean for a creation to belong to a community, especially a diffuse or fractured one? And is our national culture the product of Yankee ingenuity or cultural kleptomania? Providing new insights to communal authorship, cultural appropriation, intellectual property law, and the formation of American culture, this innovative and accessible guide greatly enriches future legal understanding of cultural production.

Book Crime

    Book Details:
  • Author : Ferdinand von Schirach
  • Publisher : Vintage
  • Release : 2011-01-11
  • ISBN : 0307595536
  • Pages : 161 pages

Download or read book Crime written by Ferdinand von Schirach and published by Vintage. This book was released on 2011-01-11 with total page 161 pages. Available in PDF, EPUB and Kindle. Book excerpt: From Ferdinand von Schirach, one of Germany’s most prominent defense attorneys, comes a jolting debut collection of short stories that daringly brings to light the motivations stirring within the criminal mind. By turns witty and sorrowful, unflinchingly brutal and heartbreaking, the deeply affecting, quietly unnerving cases presented in Crime urge a closer examination of guilt and innocence. In “Fähner,” a small-town physician and avid gardener betrays little emotion when he takes an ax to his wife’s head, an act that shocks the locals but provides a long-awaited reprieve for the good doctor. Abbas, a Palestinian refugee who is cornered into a life of crime, finds true love and seemingly a saving grace with a beautiful student named Stefanie in “Summertime.” But when she is viciously murdered in a hotel room after having been paid to sleep with one of the country’s wealthiest men, is Abbas to blame or is it the man who seems to have it all? And in the startling story “Love,” a young man’s infatuation with his girlfriend takes a grisly turn as he comes to grips with his unconventional—and uncontrollable—impulses to truly know a woman. “Guilt,” writes von Schirach, “always presents a bit of a problem.” In this beautifully nuanced and telling collection, guilt is indeed never as clear-cut as the crime, and justice is more nebulous still.
