This book was released on 2014 with total page 636 pages. Available in PDF, EPUB and Kindle. Book excerpt: The current SharÊ'ah legal framework as administered in Northern Nigeria has been in existence since long period of its ancient history. It went through distinct dimensions throughout the chronicles of its legal aggregate, starting from the pre colonial era, via the colonial epoch, up to the post independence eon. Buttressed by this SharÊ'ah framework, polygamy remains a crucial issue of Islamic family law, owing to its ample practice in Nigeria. Religion and culture are the main reasons behind its overwhelming acceptability and widespread. The religious background on polygamy undoubtedly correlated with the cultural position of the Nigerian people, thereby significantly influencing its practice. Besides overheating the controversies surrounding the practice, it is rightly argued that the mix-up of religion and culture rendered the practice inconsistent with the religious principles and its objectives in polygamy. This phenomenon posited the Nigerian framework incompatible with the contemporary developments in the legal framework of polygamous practices around the Muslim world. The main remonstrance surrounding the inconsistent practice is its pessimistic impact on the rights of women which Islamic law overwhelmingly protects. The Nigerian SharÊ'ah framework with respect to family law generally, and on polygamy in particular, is mainly based on uncodified and unregulated classical law of the Maliki School. The non codified system is seen as an efficacious factor responsible for numerous socio-legal botherations linked to polygamous practice in Nigeria. This thesis lucubrates the practice of polygamy in Nigeria and how it affects the rights of women in the Northern Nigerian states. It presents an in-depth study of the classical Maliki law and to what extent is the Nigerian practice compatible with the law. The methodology employed the library-based doctrinal research approach as well as both quantitative and qualitative empirical research approach. Bauchi state was coherently selected as a model of case study for empirical research about the practice of polygamy in Northern Nigeria. For the purpose of presenting a comparative overview of model jurisdictions, the thesis canvasses upon a concise but comprehensive appraisal of the legal framework and practice of polygamy in selected Muslim countries. It concludes with a sum-up of the thesis and a recapitulation of its salient findings and sets forth the author's suggestions. The research is aimed at proposing for the review and gradual reform in the administration of Islamic family law for an arrayed and improved SharÊ'ah implementation in Bauchi state and Nigeria at large.

Book Islamic Criminal Law in Northern Nigeria

Download or read book Islamic Criminal Law in Northern Nigeria written by Gunnar J. Weimann and published by Amsterdam University Press. This book was released on 2010 with total page 205 pages. Available in PDF, EPUB and Kindle. Book excerpt: Annotation. In 2000 and 2001, twelve northern states of the Federal Republic of Nigeria introduced Islamic criminal law as one of a number of measures aiming at "reintroducing the shari'a." Immediately after its adoption, defendants were sentenced to death by stoning or to amputation of the hand. Apart from a few well publicised trials, however, the number and nature of cases tried under Islamic criminal law are little known. Based on a sample of trials, the present thesis discusses the introduction of Islamic criminal law and the evolution of judicial practice within the regions historical, cultural, political and religious context. The introduction of Islamic criminal law was initiated by politicians and supported by Muslim reform groups, but its potential effects were soon mitigated on higher judicial levels and aspects of the law were contained by local administrators. It sheds light on how the law survived colonial rule and continues until today. Dr. Yushau Sodiq analyzes progressive elements in Islamic law over the past two centuries. He goes on to discuss many objections raised by the Nigerian Christians against the application of Islamic law, as well as how Muslims respond to such criticism. Book Boko Haram and International Law

Download or read book Boko Haram and International Law written by John-Mark Iyi and published by Springer. This book was released on 2018-06-27 with total page 429 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on Boko Haram and terrorism in Nigeria, framing the conflict in an international law context. It analyses the nature of political violence and the dominant roles of a violent nation-state (in both colonial and post-colonial experiences) and the rise of terrorism in Nigeria. The book unearths embedded evidence of religious nepotism on the part of state officials using such state institutions as Islamic Preaching Boards to promote one Islamic sect over another in mainly Muslim Northern Nigeria. The book offers insights into this subtle sectarian divide and how this and other ‘subterranean’ elements have contributed to the rise of Boko Haram in Northern Nigeria beyond the dominant poverty-terrorism nexus narrative. Furthermore, the book analyses the various components of Boko Haram’s radical ideology, situates them in Islamic Jurisprudence, and examines the philosophy of the group (both in doctrine and practice) – their interpretation of the Koran and the waging of Jihad, and the extent to which they conform to the Islamic Sect Boko Haram claims to follow. The book then examines the basic doctrinal features and characteristics of Boko Haram – waging Jihad, prohibiting revealing dresses for women and mixing of genders, rejecting western values and institutions, denouncing scientific inquiry and democracy, hostage taking, sexual exploitation of captives and other aspects of jus ad bellum and jus in bello in Islamic jurisprudence and international law. Finally, the book analyses the plight of vulnerable groups such as internally displaced persons, the atrocities committed against women and girls in the Boko Haram insurgency and the (in)ability of international law to enforce the protections offered to the victims. From the perspective of critical intellectual inquiry, the book also challenges a number of fundamental assumptions and encourages us to revisit our legal characterisation of certain concepts such as “gender-based crimes”. It then goes further to analyse some legal grey areas in the Boko Haram insurgency such as the legal status of the Civilian Joint Task Force (CJTF) and the legal framework for holding members accountable for violations of international human rights and humanitarian law. Overall, the book represents a valuable contribution to scholarship, deepens our understanding and delineates how international law could respond to the Boko Haram insurgency in Nigeria in particular and terrorism in Africa in general.
