Every word, as well as the whole spirit, of the wise sentence above quoted, is true as a delineation of the nature and circumstances of that case. The immediate question was, indeed, meum or tuum, as between the youthful Vis count Alford, and his uncle, the Honourable Charles Henry Egerton (formerly C ust). They alone were the wrestlers and gymnasts in this Olympic; but a whole crowd of public athletes were interested in the issue; for the reason and consequence of the struggle trenched to the parts of sovereignty, yea, even the very composition and purity of our constitution; and a great portion of the people were directly and manifestly concerned, because the combat of the Viscount was in the name of resistance to what, if his cause was well conceived, was a most dangerous precedent. The divisions of municipal law are now to be considered. It consists of two great branches, Rights and Remedies. Every right has a correlative wrong; that is, every right may be violated, and this violation being an injury to the party having the right, he is entitled to be restored or indemnified for the breach; the law provides for his obtaining restoration, or, if that be impossible, compensation. But another right exists on the part of the community, or rather of each of the members whereof it consists, - the right to prevent a repetition of the wrongful act, either by incapacitating the offender, that is, disabling or disinclining him to repeat his offence or by so dealing with him as to disincline others who witness the treatment which he has received, from following his ex ample. This leads to another division of law into Civil and Criminal. Certain rights are by the law declared to be vested in individuals; to enforce them or to force a remedy for the breach of them, is the province of the Civil branch of law. Certain acts are by the law declared to be crimes; to punish them is the province of the Criminal law. Hence a third division, though of a subordinate nature law may either de clzre what are men's rights, and what are crimes; or it may lay down the course to be taken by the individual who seeks redress for a violation of his rights, and by the state for punish ing those who have committed crimes. The one of these is Civil, the other Criminal Procedure. Hence a system of law must always consist of four branches Civil Law Criminal Law Civil Procedure Criminal Procedure in other words Rights Crimes Actions Prosecutions. His having refused the place of Com mander-in-chief, at least prospectively, was stated to his praise. It was said that his being successor to the great man who held the ofice had been mention ed during his life by himself, and that the Prince had at once intimated his determination to decline it, if the Sovereign should be advised to make the offer. It is quite manifest that he never could by possibility have taken the ofli co; and the wonder is that any one, above all the great Captain himself, should for an instant have allowed such a notion to pass through his mind. It is no fault of Prince Albert, and it is not his misfortune, it is his good fortune - that he was born into the world after the war had ceased; and that he has never seen ser vice. To have placed him over all the warriors of England would have been an act which hissworst enemy could hardly have advised; to have taken that position would have argued in him not merely an entire loss of the great discretion by which he has ever been guided, but a want of even ordinary prudence. To bring this anecdote for ward, then, could never raise him in our estimation; it only tended to lower others.
