Book excerpt: Excerpt from A Treatise on the Law of Fire Insurance The author has endeavored in the following work to systematize the principles deducible from the nu'merous decisions of our courts upon the complex subject of fire insurance, and thus exhibit, in convenient form, the present state of that branch of the law. In going over such an extensive field of inquiry, he cannot flatter himself that he has been so fortunate as entirely to avoid error and mistake. And he would be grateful to his professional brethren, if, in following his footsteps, they would point out to him any defects they may chance to discover in the way, so that he may be able, in any future edition, to correct them. Book The Law of Fire Insurance Classic Reprint

Download or read book The Law of Fire Insurance Classic Reprint written by Charles John Bunyon and published by Forgotten Books. This book was released on 2018-03-21 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Fire Insurance The Author has endeavoured, in the present volume, to ofi'er to the reader a view of the Law of Fire Insurance as it now exists, and as applied to the practice of Insurance Offices. Ohe imagines that such a work is wanted, and he trusts that it may be useful. This is, indeed, the only consolation of the text-writer - for, like a child digging castles in the sand, he sees each succeeding wave of judicial decisions obliterate his labours, until the lapse of a few years renders his book all but valueless, and it sinks like an old newspaper into a mere record of the past. It is very true that the same fate awaits with increasing certainty the writer in almost every other department of knowledge. The extension of education, and the advances that are every day made in science and criticism, have so multiplied books and authors, that it is only at very rare intervals that the publeation can be expected of a stand work, that will not at no distant date oe' superseded by some more perfect production. The labours of the ten-writer have, however, many uses, not only in informmg the student, and assisting the practi tioner, but in so bringing together the authorities as to detect. This book was released on 2016-09-26 with total page 268 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on Warranty in Fire Insurance Contracts In the Life Insurance contract the doctrine of Warranty in presenti is found in all its force, and justly so, because there it is natural and at home, springing from and in fact being inher ent in that contract. It is commonly stated by the text-writers that the general principles rel ative to the Life and Fire Insurance contracts are the same. No greater error can be com mited, and especially is this statement a very grave and important error as to the doctrines of Representation and of Warranty. The essen tial difference between the two contracts grows out of the objects about which they are formed. The Life Insurance contract is based always on a written application, which contains ques tions and answers going into the minutest de tails of the applicant's past and present health. Book excerpt: Excerpt from Fire Insurance Law: An Authoritative Analysis of the Standard Fire Insurance Policy, of the Standard Forms and Clauses Used in Connection Theerewith Insurable Interest. It is essential to the contract that there shall be an insurable interest. In the early days insurable interest perhaps was not absolutely requisite, although it appears to have been more so in fire insurance than either in marine insurance or in life insurance. In 1746, a statute was placed on the books in Great Britain making insurable interest necessary in marine policies. Book excerpt: Excerpt from The Standard Fire Policy: Lectures Before the Fire Insurance Club of Chicago In this case a fire occurred in the wire tower through which the wires for electric lights were carried from the building. This fire caused a short circuit, and the short circuit resulted in keeping back or bringing into the dynamo below an increase of electric current, that made it more difficult for the armature to revolve than before, and caused a higher power to be exerted upon it; that this was transmitted to the pulley by which this armature was run through a belt. The 'shock destroyed that pul ley, and by the destruction of that pulley the main shaft was disturbed, and the succeeding pulleys, up to the jack pulley, were ruptured. By reason of pieces flying from the jack pulley, or from some other cause, the flywheel of the engine was destroyed. Download or read book A Treatise on the Law Relating to Insurance Vol 1 of 3 written by David Hughes and published by Forgotten Books. This book was released on 2017-12-06 with total page 512 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law Relating to Insurance, Vol. 1 of 3: In Three Parts, Viz, Marine Insurance, of Insurance on Lives, of Insurance Against Fire Considerable advantage has accrued to the Author from the period at which his Work has been undertaken. For he has been enabled to avail himself of much new and valuable discussion. The various forms assumed by com merce, and the changes which daily take place in the habits and dealings of mankind, have given rise to new laws and fresh topics of legal investigation. At the same time, he has Een enabled, by reason of the law having become set tled, to divest his pages of much elaborate argument, justly considered necessary at an earlier period the introduction of which into a Treatise of this nature, cannot, it is presum ed, be deemed essential, with regard to points which are now laid up among the elements of our jurisprudence, and regarded as too well established to be shaken. In addition also to the alterations thus suggested in the plan of the pre sent Work, it may be proper to observe, that some recent decisions of considerable importance have occurred, which now appear for the first time.
