Gordon and London City and Midland Bank v. Gordon have been upheld on appeal to the House of Lords, with a variation not affecting the case so far as the cheques were concerned, but only as to the drafts (1903, A. C. 240). There has also been an important Privy Council case - Imperial Bank of Canada v. Bank of Hamilton (1903, A. C. 49). Further, a bill was introduced and passed a third reading in the House of Lords, which had for its object the amendment of s. 82 so as to destroy the effect of the judgment in Gordon's Cases on the construction of the words "receives payment for a customer." Possibly this measure will be reintroduced in the coming session. The Introduction has been omitted in this edition, and certain matters treated in the Introduction in former editions have been relegated to the text. Bigelow, LL. D., and was not suited fully for the use of students in the class-room as a basis of study. The present edition, made necessary by the re vision of_ the text-book, and by the codification of the subject, has been prepared, following the order of the revised text, especially for such use. Accordingly, it has been necessary to enlarge the book greatly by the addition of many cases; and this has been done with the aim to collect a set of illustrative cases which shall present as comprehensive a view of the subject as can be treated in a course in school. The plan of the book is to lead the student, in his study, to look upon the law of the subject from the standpoint of the law merchant; accordingly, cases have been selected, when possible, which put in the foreground the customs of merchants and bankers as the basis of decision. The head-notes to the cases are aimed to enforce the point, and, at the same time, to present a concise and, as far as possible, a continuous statement of princi ples and rules, which are illustrated by the cases. No attempt has been made to prepare a complete annotation of the law of commercial paper, and, in so far as notes have been added or citations given to the Statute Or the authorities, the purpose has been to aid in bringing the student to a right point of view, and at the same time developing a working knowledge of the law as it is. A check is denominated a species of inland bill of exchange, - not with all the incidents of an ordinary bill of exchange, it it true, - but still it belongs to that class and character of commercial paper. When an instrument is drawn upon a bank, or a person engaged in the banking business, and simply directs the payment to a party of a specified sum of money, which is at the time on deposit with the drawee, without designating a future day of payment, the instrument is to be treated as a check. Book excerpt: Excerpt from The Law of Bills, Notes and Checks The object designed for the following volume is to guard those dealing with commercial paper and point out the dangerous spots as determined by the leading decisions of the courts of all the states. Although apparently plain, the provisions of the Negotiable Instruments Law have been the subject for many thousand legal actions and but few sections have escaped the necessity of legal interpretation. It was the aim to condense these decisions in language that would be plain to the bank clerk, bank director and the layman dealing with commercial paper, and also to collect the leading decisions for the legal practitioner for ready reference. The want of a book of this nature has been generally expressed by bankers and the legal profession, and although the author makes no pretension to. having fulfilled the requirements, it is hoped that the book may be found of service. In order that important matters might be more forcibly impressed on the reader's mind, illustrations of negotiable and non-negotiable paper have been supplied, as have also forms used in connection with commercial paper and banking. It has been the aim of the courts in tho forty-four states in which the Negotiable Instruments Law has been adopted to construe the law to make it uniform wherever questions of the interpretation of the statute have been presented. Were this not the case the object of the framers and advocates of the law would be lost and the intent of the State Legislatures towards uniformity be reduced to wreckage. While the Law is, with few exceptions, uniform, the numbering of the sections vary. For convenience the numbering of the New York' statute has been followed, with a table of the corresponding sections of the other states. From an almost overwhelming mass of law and precedent selection has been made of what seemed to be the most important and useful. Trusting that the volume may often aid and seldom mislead, it is submitted to the legal profession, bankers and others dealing with commercial paper. It is not enough to state a doctrine and to support it by an array of decisions, even if decisions to the contrary are also cited. The correctness of the doc trine itself should be established by conclusive reasoning, or it should be shown that the particular doctrine, though supported by a long array of decisions, is not in accord with some accepted principle of law. If a textbook is to have authority, it must, therefore, be something more than a collection of authorities. I have used largely Bigelow's excellent book, The Law of Bills, Notes, and Cheques; Ames' Cases on Notes and Bills; and The Negotiable Instruments' Law; citing many decisions under that law, as well as earlier decisions. Many more might have been added but for the limitations of space. I have borrowed largely from Ames' Index Digest to his collection of cases because his admirable terse statements cannot be bettered.
