Book The Legal Foundations of Free Markets

Download or read book The Legal Foundations of Free Markets written by Stephen F. Copp and published by . This book was released on 2008 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, Stephen Copp has brought together some of the world's leading figures in the field of law and economics to discuss questions that are central to our understanding of how a free-market economy operates. Though most people accept that a free economy cannot exist in a legal vacuum, important questions about how systems of law come into being and what form they should take remain in dispute. The authors shed light on some of these issues, such as whether common law systems are better than codified law systems; the relationship between natural law and government law; whether systems of law evolve within societies or are imposed from above by government; and, the role of human rights, as guaranteed by constitutions. After examining these questions, the authors then proceed to look at specific problems that are frequently disputed by economists - such as the role of competition law; the relationship between law, regulation and economics; and, how the law can protect the environment without onerous regulation. This collection is an important contribution to the literature in the field of law and economics. It is important both for economists who wish to understand more about the origins and purposes of law and regulation, and for lawyers who need to understand more about the economic foundations of sound legal systems.

Book Governing Children Families and Education

Download or read book Governing Children Families and Education written by M. Bloch and published by Springer. This book was released on 2016-09-27 with total page 344 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a collection of essays that address the international changes in welfare policy. The book discusses the new patterns of governing associated with the notions of welfare, care, and education that emerge during the late Twentieth and early Twenty-first-centuries. The issues examined are, among others, the role of international donors and their emphasis on efficiency and lower social subsidies, international migration and its impact on welfare policy inclusions (and exclusions), and national policy change. While representing many different locations and traditions, contributors work within a variety of critical theoretical perspectives that critique our cultural ways of reasoning about the care and education of the child, the role and practice of the state, and the social and cultural construction of citizenship and nationhood.

Book Kashmir in Conflict

Download or read book Kashmir in Conflict written by Victoria Schofield and published by . This book was released on 1996 with total page 367 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Why has the valley of Kashmir, famed for its beauty and tranquillity, become a major flashpoint, threatening the stability of a region of great strategic importance and challenging the integrity of the Indian state? This book examines the Kashmir conflict in its historical context, from the period when the valley was an independent kingdom right up to the struggles of the present day. Located on the borders of China, Central Asia and the Sub-Continent, the insurgency in the valley has also created serious tensions between India and Pakistan. Drawing upon research in India and Pakistan, as well as historical sources, this book traces the origins of the state in the 19th century and the controversial "sale" by the British of the predominantly Muslim valley to a Hindu Maharaja in 1846. Through an exploration of the implications for Kashmir of independence in 1947, it gives a critical account of why, for Kashmir, self-determination may seem a more attractive option than affiliation to a larger multi-racial whole."--Bloomsbury Publishing.

Download or read book Transforming Hawai i written by Paul D’Arcy and published by ANU Press. This book was released on 2018-06-05 with total page 341 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study examines the role of coercion in the unification of the Hawaiian Islands by Kamehameha I between 1782 and 1812 at a time of increasing European contact. Three interrelated themes in Hawaiian political evolution are examined: the balance between coercion and consent; the balance between general structural trends and specific individual styles of leadership and historical events; and the balance between indigenous and European factors. The resulting synthesis is a radical reinterpretation of Hawaiian warfare that treats it as an evolving process heavily imbued with cultural meaning. Hawaiian history is also shown to be characterised by fluid changing circumstances, including crucial turning points when options were adopted that took elements of Hawaiian society on paths of development that proved decisive for political unification. These watershed moments were neither inevitable nor predictable. Perhaps the greatest omission in the standard discourse on the political evolution of Hawaiian society is the almost total exclusion of modern indigenous Hawaiian scholarship on this topic. Modern historians from the Hawai‘inuiākea School of Hawaiian Knowledge at the University of Hawai‘i at Mānoa argue that political leadership and socioeconomic organisation were much more concensus-based than is usually allowed for. Above all, this study finds modern indigenous Hawaiian studies a much better fit with the historical evidence than more conventional scholarship.
