I have called the work a treatise, although I have presented it in the form of illustrative or leading cases, with notes. But in doing this I have not misnamedx it in order to obtain for my work a more dignified title. The notes are my treatise. If any one should object that he is called upon to pay for one hundred and fifty pages of cases taken bodily from the reports which are at his hand in his own library, or which he can consult else where, I shall simply reply that he obtains them without any extra charge. In order to admit them into my book, the notes are printed in a type three sizes smaller than that in which legal treatises are ordina rily printed. Thus, while neither its size nor its cost to the profession has been increased at all, I am satisfied that its usefulness to the many members of the bar who are unable to obtain access to a complete library of reports will be greater in its present than it would have been in the more usual form of a legal text - book. And even those who can obtain in their original volumes all the cases I have here reprinted. Will hardly refuse to recognize the desirability of having within the covers of a single volume all the leading cases upon this branch of the law. Because we never can make'for ourselves a conception of such a life, and we never can and never will see the form of a single body with our naked eyes, we therefore call it a spirit life, but all the same it must have a form in which to exist, for an immaterial and formless life is a nothingness, and can exist only in our imagination. After this enlighten ment we will begin to wonder how it was possible for us, trying to discover the cause of life and the creation of our thoughts in the solid buildings of our body, and not in that individual free moving life therein. What is, and how can we understand the so-called natural law? In spite of all our latest discoveries, we still explain the origin and development of all life in the universe, and that on our earth with the simple words only: it is natural law. Every human being is convinced that such a universal law must exist. But if we acknowledge the existence of such a natural law then we admit unconsciously the fact that there must undoubtedly exist, too, a ruling and supreme life, which is capable of enforcing this universal law. We know that in every ship, in every state or nation, there exists a government to rule the individual life therein, and we know, too, that all the laws that are made by that highest governing body in a state or in a great nation, can not be enforced direct by that central government, but only indirectly, from above downward, through the governments of the indi vidual states and communities, or their agents, because it is impossible to reach and control all individual life in a great body, through one single government only, and therefore all the many individual bodies therein must in turn have a govern ment by themselves.
