Download or read book The Selection and Removal of Arbitrators in Investor State Dispute Settlement written by Chiara Giorgetti and published by BRILL. This book was released on 2019-09-24 with total page 99 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Selection and Removal of Arbitrators in Investor-State Dispute Settlement examines two essential features in investor-state dispute resolution: how arbitrators are selected and removed. Both topics have received increasing scrutiny and criticism, that have in turn generated calls for reforms. In its first part, Professor Chiara Giorgetti, an expert in international arbitration, explains the selection of arbitrators procedurally and comparatively under the most-often used arbitration rules. She then reviews critically arbitrators’ necessary and desirable qualities, and addresses some important and related policy issues, such as diversity and repeat appointments. In her work, she also includes an assessment of the calls to review how arbitrators are appointed, and specifically the proposal by the European Commission to create a permanent tribunal to resolve international investment disputes, the UNCITRAL Working Groups III Reform Process and the rules amendment proposal undertaken by the Secretariat of the International Center for Settlement of Investment Disputes. In its second part, this monograph examines how arbitrators can be removed and reviews first the applicable provisions, under a variety of arbitration rules, to remove arbitrators who fail to possess the necessary qualities. It then also reviews the relevant case-law on challenges. The monograph assesses appointments and removals in a multifaceted and comprehensive way, and includes a critical assessment of the reasons and calls for reform of the ISDS system.

Download or read book Migration Settlement and Belonging in Europe 1500 1930s written by Steven King and published by Berghahn Books. This book was released on 2013-11-01 with total page 325 pages. Available in PDF, EPUB and Kindle. Book excerpt: The issues around settlement, belonging, and poor relief have for too long been understood largely from the perspective of England and Wales. This volume offers a pan-European survey that encompasses Switzerland, Prussia, Belgium, the Netherlands, and Britain. It explores how the conception of belonging changed over time and space from the 1500s onwards, how communities dealt with the welfare expectations of an increasingly mobile population that migrated both within and between states, the welfare rights that were attached to those who “belonged,” and how ordinary people secured access to welfare resources. What emerged was a sophisticated European settlement system, which on the one hand structured itself to limit the claims of the poor, and yet on the other was peculiarly sensitive to their demands and negotiations.

Book excerpt: #1 NATIONAL BESTSELLER • NATIONAL BOOK CRITICS CIRCLE AWARD WINNER • The true story of one man so determined to take down two of the nation's largest corporations accused of killing children from water contamination that he risks losing everything. "The legal thriller of the decade." —Cleveland Plain Dealer Described as “a page-turner filled with greed, duplicity, heartache, and bare-knuckle legal brinksmanship" by The New York Times, A Civil Action is the searing, compelling tale of a legal system gone awry—one in which greed and power fight an unending struggle against justice. Yet it is also the story of how one man can ultimately make a difference. Representing the bereaved parents, the unlikeliest of heroes emerges: a young, flamboyant Porsche-driving lawyer who hopes to win millions of dollars and ends up nearly losing everything, including his sanity. With an unstoppable narrative power reminiscent of Truman Capote’s In Cold Blood, A Civil Action is an unforgettable reading experience that will leave the reader both shocked and enlightened. Download or read book Parish and Belonging written by K. D. M. Snell and published by Cambridge University Press. This book was released on 2006-11-16 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: What role did the parish play in people's lives in England and Wales between 1700 and the mid-twentieth century? By comparison with globalisation and its dislocating effects, the book stresses how important parochial belonging once was. Professor Snell discusses themes such as settlement law and practice, marriage patterns, cultures of local xenophobia, the continuance of out-door relief in people's own parishes under the new poor law, the many new parishes of the period and their effects upon people's local attachments. The book highlights the continuing vitality of the parish as a unit in people's lives, and the administration associated with it. It employs a variety of historical methods, and makes important contributions to the history of welfare, community identity and belonging. It is highly relevant to the modern themes of globalisation, de-localisation, and the decline of community, helping to set such changes and their consequences into local historical perspective.
Download or read book Essex Pauper Letters 1731 1837 written by Thomas Sokoll and published by Oxford University Press. This book was released on 2006-03-09 with total page 802 pages. Available in PDF, EPUB and Kindle. Book excerpt: The immensely rich archives from the administration of the English poor law before 1834 include letters to the overseers of the poor that came from the poor themselves. As personal testimonies of people claiming relief, which are often written in a stunningly 'private' tone, pauper letters allow deep insights into the living conditions, experiences and attitudes of the labouring poor in the late eighteenth and early nineteenth centuries. This edition contains some 750 of these letters, all those presently known to survive in the county of Essex. The Introduction demonstrates the immense importance of this neglected source, both for the social historian and for the comparative study of literacy.
