The right of a tailor to keep the coat which he has made from his customer's cloth, until his charges are paid, is such a lien. It is, at common law, a right of detention, not of sale. It presupposes possession of the chattel acquired by the consent of the owner; it cannot begin in a forcible or involuntary dispossession of the owner, by the person asserting it. Book The Law of Negligence Vol 1 of 2

Download or read book The Law of Negligence Vol 1 of 2 written by Seymour D. Thompson and published by Forgotten Books. This book was released on 2017-12-20 with total page 824 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Negligence, Vol. 1 of 2: Relations Not Resting in Contract; Illustrated by Leading Cases and Notes The preface of a book ought to be a brief advertisement of its con tents and purposes, from the author's point of view. These volumes embody an attempt to classify and present the case-law of England and America on the subject of Negligence, in relations not springing out Of contract, in a form which it was thought would prove most useful and convenient to practising lawyers. Dismissing the definitions of negli gence which are usually given in the law-books, the writer came to the conclusion that its proper legal meaning is a failure of duty, generally unintentional, but sometimes intentional.1 The foundation of every action for negligence is, therefore, a duty on the part of the defendant toward the plaintiff to abstain from doing what he did, or to do what he failed to do. Book excerpt: Excerpt from The Law of Railroads in Pennsylvania, Including the Law Relating to Street Railways, 1893, Vol. 1 of 2 In a State where there have been already published over five hundred volumes of reports, text-books based npon the law as declared by the State courts are an appropriate and almost mafia! Aid to every practitioner. Such works are also becoming more and more necessary owing to the increas ing tendency of our courts to look only to Pennsylvania de cisions for precedents. In the particular subject of railroad law no State has so completely covered the field as Pennsyl vania. Almost every legal proposition on the subject may be supported and illustrated by cases from our own reports. In some particular subjects the variety of cases is astonishingly great, and extends to almost every conceivable combination of circumstances. The chapters on Stock Subscriptions, and some of the chapters on Negligence in the present work are illustrations of this. Book The Statutes at Large of Pennsylvania Vol 2

Download or read book The Statutes at Large of Pennsylvania Vol 2 written by James T. Mitchell and published by Forgotten Books. This book was released on 2016-06-20 with total page 686 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Statutes at Large of Pennsylvania, Vol. 2: From 1682 to 1801 This volume, though issued first, is the second in the series, and is, therefore, so numbered. The plan of the publication, as directed by the Legislature, includes not only the text of the laws passed since October, 1700, but also such illustrative matter, legal and historical, as the Commission find appropriate. To meet this requirement and to have in chronological order the whole body of statute laws from the foundation of the colony, it is deemed necessary to reprint the charters and laws enacted prior to the period men tioned, together with the action of the Crown upon those laws the unpublished commissions and secret instructions to the several deputy governors, which explain many of the difficulties they labored under in assenting to the enactments of the assembly; and the various essential documents on which our colonial legislation was fundamentally based. This material, much of which was only to be procured by diligent search among the papers of the Historical So ciety of Pennsylvania, the Public Record Office in London, and else where, will properly form the introductory volume, and will, there fore, be called number one. Its publication, however, is deferred with the view of obtaining some additional matter, and for the pur pose of inserting a general survey of the work, which latter can only be prepared after all the subsequent volumes are in type. The present volume contains the earliest legislation still in force. The enrolments of the laws are defective in many instances, age having caused the originals to crumble and decay. The defects have been made good from the Act Books, and are indicated by the use of brackets. Occasional clerical lapses and omissions, also, have been supplied by the Commission, and are indicated in a similar manner. The notes and index to this volume have been prepared, under the supervision of the Commission, by Charles R. Hildeburn, with the assistance of Edwin Jaquett Sellers and Isaac Elwell, Esquires.
