If a Ditcher want to deprive a Denison of his preferment, and inflict severe penalties on his erring brother, he runs to his attorney, who takes him to his proctor, who refers to his counsel, who introduces him to the judge, who settles the dispute. If a confederacy of devout parsons who know that they, and they alone, hold the truth, desire to avenge them of the vicar of Brading, after taking sweet counsel of themselves they must proceed to take dear counsel of their lawyers. The lawyer is, indeed, the arbiter of religious truth in England, and, be the task tasteful or nauseous, he must acquaint himself with the theological and ecclesiastical system about which men delight to litigate. Moreover, he must extend his investigation to divers dissenting communities, preparing himself for many questions connected with chapels, congregations, and ministers, which will spring forth occasionally. Nor is it an easy part of his professional duties, whether he practise in a village, or before the highest tribunal in the country, to conduct such suits. Still less easy is the task of exerting his influence in mollifying party warfare, and rendering placable those Christian volunteers of the church-militant, who show their pugnacity and zeal, by hunting out and stabbing co-religionists supposed to have some flaw in their creed. Book excerpt: Excerpt from The Law Magazine, or Quarterly Review of Jurisprudence, 1861, Vol. 14 Most opportunely, therefore, while all people are agreed that reform is needed (the only question being how far it can with safety and advantage be carried), and while the new Common Law Commission are issuing suggestions, halting and faltering, willing, perhaps, but unable, to free their minds from that peculiar tone which long and successful practice under our present system inevitably induces; while, too, some have been found to advocate our going over to Rome (in the present day rather a taking idea), there to find by means of a "Praetor" relief for our manifold legal miseries, and a cloud of pamphlets have appeared, each advocating some changes and exposing some acmses, -a practical people in the western hemisphere have appointed a commission, and quietly, expeditiously and cheaply (wishing, probably, to same our Criminal Law Commissioners, who have passed fifteen years, spent thousands, and published reports without end and without result), and out of laws similar to our own and derived from us, have created a simple, single, and intelligible judicial system, which has hitherto worked well in the state (New York) by which it was first sanctioned, and has in consequence been adopted by several other states of the American Union. This new system was explained at a meeting of the Law Amendment Society, on Monday, the 17th of November, by Mr. Field, one of the commissioners who prepared the Code above alluded to, and we now propose to introduce to our readers some of the leading provisions of this Code, which has made such radical changes in the old law, and which is said to answer fully and well every requirement of a practically intelligent and eminently commercial people. And here we must quote an admirable passage of Hallam (Mid. Ages), which, it appears to us, the New York commissioners have fully carried out: "Let us not be deterred by a clamour against innovation from abrogating what is useless, simplifying the complex, or determining what is doubtful, nor attempt to stave off an immediate pressing difficulty by a patch-work scheme of modifications and suspensions, but let us consult for posterity in a comprehensive spirit of legal philosophy." The instructions the commissioners received were indeed precise, and left them no room, had they desired it, to narrow their scope. He was not content with issuing simply a code or digest; but he promulgated both, as also a brief summary of legal principles, together with various collections of the Imperial rescripts, though, unhappily, he did not weld these together. We thus find historical analogy as well as first principles to be altogether on the side of a comprehensive system of reform, such as the Law Digest Commissioners seem to contemplate. The codification of French law under the First Napoleon, with so few elements of a digest, was of practical use, only because old rules of law and of interpretation were purposely ignored to a great extent by the disciples of the political school of '89. Were the Third Napoleon now to reconstruct the French codes, the additions thereto would doubtless consist mainly of decisions passed under sections of the existing compilation. That it should be left to private feeling in any case, to draw the line between tort and crime, is an anomaly which cannot be defended by any one taking a rational view of the obligation of the executive, but in the case under notice, it is rendered all the more objectionable by the effect the accuser's decision has upon the position of the accused. After reading Emlyn's preface, it is curious to notice how very much easier it now is to convict of crime than to cast in damages in such cases. The combined effect of an old saw and a modern statute is, to place the prisoner, as distinguished from the defendant, at a very serious disadvantage. Recent legislation has made the parties to civil actions competent and compellable witnesses in their own cause, and therefore, a plaintiff suing one who has assaile! His body by blows, or his reputation by words, may be met with the testimony of his assailant, given under the same sanction, and open to the same scrutiny, as his own. An assault may be committed, or a libel written, under circumstances which, if detailed by an honest defendant, will save him from any but nominal damages, or may even obtain him a verdict from a sympathising jury. But let the same charge be preferred against him in a criminal court, and his oppor tunity of telling his own story is gone. The conditions may be the same, but he cannot detail them, nor will the jury know of them at all, unless his counsel can prove them aliunde, or better still, can extract them on cross-examination so that if the offence originated in some matter resting peculiarly in the knowledge of the two parties, an unscrupulous prose cutor has his adversary completely at his mercy.
