It has been said that liberty depends on the freedom of the press. However, when these freedoms and rights are left unrestricted or without borders there are likely to be abuses. This write-up looks to figure out the provisions in the 1992 constitution that protect the independence and freedom of the press and also try to find out if there are other provisions in the constitution as well as other legal documents that act as checks on these rights and freedoms. The write-up will later examine situations that could warrant deliberate restrictions on media freedom. The write-up has been organized into seven sub-headings namely; article 162 of the 1992 constitution, the media, brief history of the media in Ghana, press freedom and the role of the media in Ghana, the need for press freedom in Ghana, abuses of press freedom in Ghana and circumstances that would warrant restrictions on the media without jeopardizing the human rights of Ghanaians.

However, if their operations are not properly and efficiently regulated, it can lead to underdevelopment. Hence, this study focused on the prospects of regulating electronic media activities in Ghana by using the National Media Commission (NMC) as a case study. The mixed research method was used as well as primary and secondary data. The primary data was collected through questionnaires and interview guides. Purposive and simple random sampling techniques was used to select 100 respondents for the study. The findings of the study revealed that there are various existing regulations governing the electronic media in Ghana. It was also found that there are problems and challenges facing the NMC in the discharge of its duties. This has to do with the electronic media ownership, employees and team compositions and the internal weaknesses electronic media houses in ensuring adhering to the NMC regulations. The study recommends that Ghana Parliament should pass a law to empower the NMC to be more biting.

Book excerpt: Applying a legal pluralist framework, this study examines the complex interrelationships between religion, law and politics in contemporary Ghana, a professedly secular State characterised by high levels of religiosity. It aims to explore legal, cultural and moral tensions created by overlapping loci of authority (state actors, traditional leaders and religious functionaries). It contends that religion can function as an impediment to Ghana’s secularity and also serve as an integral tool for realising the State’s legal ideals and meeting international human rights standards. Using three case studies – legal tensions, child witchcraft accusations and same-sex partnerships – the study illustrates the ways that the entangled and complicated connections between religion and law compound Ghana’s secular orientation. It suggests that legal pluralism is not a mere analytical framework for describing tensions, but ought to be seen as part of the solution. The study contributes to advancing knowledge in the area of the interrelationships between religion and law in contemporary African public domain. This is perhaps because Human Rights scholars have different opinions about the concept. Human Rights are “generally moral rights claimed by everyone and held against everyone, especially against those who run social institutions’’, (Orend 2002 ). At the global stage, the United Nations (UN) has for years played a leading role in promoting and protecting human rights with support from International Non-governmental Organisations. In addition to the effort of the United Nations (UN), the state has basically been seen as the main actor in the promotion and protection of Human Rights. Unfortunately, states according to Hakemulder et al (1998), are often the very abuser of the rights of the citizens they are required to protect. It is noteworthy however that though the state bears the primary responsibility in issues of human rights, other organs of the society are included in the protection and promotion of Human Rights, (Addo, 1999). These organs, institutions and mechanisms include constitutions, law and legality, the courts among others. This write-up is about to discuss one of such mechanisms, the mass media in relation to how it carries out it promotion and protection role of Human Rights. Although there are International Human Rights Instruments which the United Nations (UN) has produced to serve as common standard of achievement of all people, countless Human Rights Violations occur locally and across the globe. These violations could be committed by the state as well as non-state actors. Non-state actors violate people’s Human Rights through direct involvement or indirectly when they consent to such violations. Non-state actors such as individuals, groups, informal or organized, ad hoc or continuous, may pose as violators, protectors or intermediaries.
