Book Powers of Attorney in Australia and New Zealand

Download or read book Powers of Attorney in Australia and New Zealand written by Berna Collier and published by Federation Press. This book was released on 1992 with total page 470 pages. Available in PDF, EPUB and Kindle. Book excerpt: From a review in the Australian Law Journal:"This book is a delightful surprise, for within its bare title the authors have covered the law concerning powers of attorney on both sides of the Tasman. The text is written in a clear and lucid fashion. It is well laid out, and provides in convenient form the texts of the relevant legislation applying throughout Australia and in New Zealand. It provides an accurate summary of the law as applying at the end of 1992. The index is unusually comprehensive, and the coverage of this area of law is thoroughly professional. It should prove to be a most useful text for practitioners in areas of company law, probate, and family law who will appreciate the specimen forms and clauses offered. It is so wide in its potential utility that (given its sensible price) it should be on every solicitor's bookshelf."

Book The Torrens System Indefeasibility and the Fraud Exception

Download or read book The Torrens System Indefeasibility and the Fraud Exception written by Bill Sarwari and published by GRIN Verlag. This book was released on 2013-09-18 with total page 25 pages. Available in PDF, EPUB and Kindle. Book excerpt: Essay from the year 2012 in the subject Law - Civil / Private / Law of Obligation / Property Law, grade: 97% High Distinction, , course: Master of Business Law, language: English, abstract: Indefeasibility in its pure form is a simple concept. In essence, the name of a registered proprietor on the land register is conclusive proof of legal ownership of land. In practice, however, the concept is far from simple. This paper critically explores the concept of indefeasibility by comparing the Torrens system of title by registration with that which went before: title by deed. In doing so, this paper clearly sets out the objectives of the Torrens system. The exploration then goes on to an examination of a particular qualification to indefeasibility in the shape of the fraud exception, and finally suggests some improvements that could be made to the doctrine.

Book Caveats Against Dealings in Australia and New Zealand

Download or read book Caveats Against Dealings in Australia and New Zealand written by Shannon Lindsay and published by Federation Press. This book was released on 1995 with total page 356 pages. Available in PDF, EPUB and Kindle. Book excerpt: This work has been written by a practitioner for the benefit of practitioners. The two introductory chapters deal with broad general principles and conceptual issues such as what is a caveat? and what is a caveatable interest? but the bulk of the book is taken up by an encyclopaedic analysis of all of the reported Australian and New Zealand cases touching upon caveats. Essentially this book is intended to function as a road map for practitioners to the reported cases, guiding them to cases involving similar facts, and breaking the issues up in a way that matches the practical problems with which they must deal.Chapters which follow on from the general introductory chapters:list all the recognised categories of situations where there is a caveatable interestdeal with defects in the drafting of caveatsdescribe the procedures available to a registered proprietor or other interested person for freeing the title from the caveatanalyse the criteria for a successful action for compensation for wrongful lodgement of a caveatexplain the role of caveats in determining equitable prioritiesThere is also a brief chapter dealing with the assessment of stamp duty on caveats.
