Book excerpt: Case Study from the year 2017 in the subject Sociology - Law and Delinquency, , language: English, abstract: This study is intended to investigate determinants of operational plans implementation in Kenya Prisons Service in Nyeri County. The thematic focus is on prison population, rehabilitation, organization culture and organization resources. Towards achieving this, the study purposively targets a case of Nyeri Command in Nyeri County to form a basis for objective generalization. The county has four institutions: Regional office, Nyeri Main, Nyeri Medium and Nyeri Women Prisons that constitute a command in whose purview the target population of 582 members of staff is constituted. Sampling was conducted by proportional stratified sampling to generate ultimate respondents of 34 members of staff from the management and heads of sections whose views and opinions led to the study's generalizations. The relevant data was collected using questionnaires from 32 respondents representing 94.1% response rate out of the probable 34. Collected data was analyzed using statistical package for social sciences (SPSS) to generate descriptive and inferential statistics. Determinants that influence operational implementation of strategic plans in Kenya Prisons Service at Nyeri Command were measured using linear and multiple regression analysis. The finding of the study indicates that inmates' population and resource availability had a positive and significant effect on implementation of operational plans in Kenya Prisons Service while rehabilitation programs and organizational culture had a positive but insignificant effect on the implementation of operational plans in Kenya Prisons Service. The researcher recommended that the government should come up with policies of addressing inmate population and mechanism of dealing with problems associated with increased level of inmates' population. In addition, Kenya Prisons Service should be fully facilitated by the government to offer various Rehabilitation programs ranging from vocation training, guidance and counseling, spiritual care and development among others, further the study recommends that government should allocate sufficient funding to the Kenya Prisons Service to enable them to be able to implement the operational plans effectively. The study suggested that future research could carry out a study focusing on the challenges that the Kenya Prisons Service encounters when implementing operational of strategic plans.

Book excerpt: This book draws international attention to the autonomy of the child accompanying incarcerated mothers, and those they leave behind in the community, despite being dependent on the convicted caregiver. Adopting a child rights perspective, the study explores how courts could go about sentencing mothers of young children for the commission of criminal offences, whilst protecting the rights of the child as envisaged under the United Nations Convention on the Rights of the Child (UNCRC). Drawing on the author’s experience as a sentencer in the Kenyan court and with reference to domestic, regional and international law, the book argues that children’s rights are presently left in abeyance when their mothers are sentenced to imprisonment, and that greater efforts should be made to recognize and give effect to the child’s existence as an autonomous equal holder of human rights, despite being dependent on the convicted caregiver. It explores the application of precedence as well as the court’s discretion in view of the dependent child, and concludes that policy reform in this respect calls for change in attitude and approach on women and children’s issues. Observing that internationally, most women imprisoned with their children fall beneath the custodial threshold set by law, the research examines how current sentencing practices could be reformed, and suggests harnessing the Power of Mercy Committee, the Sentencing Guidelines and progressive practices from developed countries in protecting the child’s rights by imposing non-custodial sentences for the offending mothers. It is concluded that in all jurisdictions, strict accountability for the dependent child should be situated with the judiciary, and that the same should be pronounced as a mandatory legal requirement. The book will be a valuable resource for academic, researchers and policy-makers working in the area of international children’s rights law and criminal law.

Book excerpt: In this essay, I will focus on prison systems and inmate experiences in Kenya. Prisons and systems of punishment come in different contexts. Generally speaking, prisons are intended to rehabilitate and transform inmates into better people for themselves and society. However, in retrospect from the historiography of African prison systems and prison writing in Kenya, prisons have moved away from their intended purpose of rehabilitation. The structure of this research project is divided in two parts. In Part, I will historicize prisons in Africa and the historical context of the injustice of power and dominance in Kenya. Part II of this essay will uncover the truth of Kenya's prison system through inmate experiences in the twentieth century. I argue that prison writings, which I call freedom papers, show that there is a continuity between colonial and postcolonial prisons, and that there were various forms of resistance against discriminatory and oppressive institutions. However, these forms of resistance depended on who was elite and non-elite.
