That renders it impossible to fix when the child died, and therefore impossible to prove child-m urder, unless the child has been seen living, because the wilful destruction of the child may have taken place before it was fully born. Its skull may have been fractured, or its brain pierced by a sharp instrument, or it may have been strangled after it has breathed and before it is born. Book excerpt: Excerpt from The Journal of Jurisprudence, 1868, Vol. 12 The conclusion which some critics draw from all this is that the Court of Session has no adequate functions to perform, and should therefore be abolished The conclusion which we draw is a very dif ferent one: we think that there are important and adequate functions which the Court of Session ought to perform; we think that the Court, were it better regulated, could perform these functions to the great advantage of the community; we think further, that the speedy and efficient discharge of these functions would afford ample occupa tion for the Court; and our conclusion therefore is, not abolition, but Reform In other words, the evil is not that the Court is too large for the business of the country, but that the business of the country does not come into the Court - that it is transacted in other ways, and by other means, and that less satisfactorily than it would be by a Supreme Court in good working order. There is at present a great gulf between the Court and the ordinary litigation of the country; but there is plenty of work for the Court of Session to do, and work which, in the interest of the community, ought to be done by that Court, and which certainly would be done by it, were it not for the defects of that Court as a working machine. He was not content with issuing simply a code or digest; but he promulgated both, as also a brief summary of legal principles, together with various collections of the Imperial rescripts, though, unhappily, he did not weld these together. We thus find historical analogy as well as first principles to be altogether on the side of a comprehensive system of reform, such as the Law Digest Commissioners seem to contemplate. The codification of French law under the First Napoleon, with so few elements of a digest, was of practical use, only because old rules of law and of interpretation were purposely ignored to a great extent by the disciples of the political school of '89. Were the Third Napoleon now to reconstruct the French codes, the additions thereto would doubtless consist mainly of decisions passed under sections of the existing compilation. The old entail law of Scotland was felt by every one to be an anachronism in the nine teenth century. Yet, absurd and indefensible as the system was, it had a strong hold on the affections and prejudices of the landed proprietary. Its reformation was the unaided act of a strong-willed and liberal-minded legislator. The public has never sufficiently appreciated the value of those changes by which the restraints that were formerly placed on the transmission of entailed property have 'been entirely swept away, and the law of destinations regulated in conformity with the principle of the English statute de Donis. But we are persuaded, that when the history of our times comes to be written, Lord Rutherfurd's Entail Act will be acknowledged to be one of the most beneficial changes that has ever been effected in the local institutions of Scotland. In the first place, a crossing, whether Special or general, was made a material part of the cheque, and its alteration or obliteration was forbidden. Secondly, it was declared that a cheque crossed specially was not to be paid except to the banker named in the crossing; and, thirdly, a lawful holder was allowed to cross a cheque, either specially or generally, or to alter a general crossing into a special crossing. Where a lawful holder crossed a cheque specially, the banker on whom it was drawn was forbidden to pay it to any other than the banker named in the crossing, but by a curious omission no provision was made for the case of a cheque.
